12585I RESOLUTION NO. 12,585 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO EXECUTE A PUBLIC AGENCY 4 SERVICES AGREEMENT TO PROVIDE FLEET MAINTENANCE AND REPAIR SERVICE FOR 5 LITTLE ROCK HOUSING AUTHORITY VEHICLES AND EQUIPMENT; AND FOR OTHER 6 PURPOSES. 7 8 WHEREAS, Arkansas Statute S 25- 20- 108(a) authorizes one or more public agencies to contract 9 with any one or more other public agencies to perform any governmental service, activity, or undertaking 10 which each of the public agencies entering into the contract is authorized by law to perform alone; and 11 WHEREAS, the City owns and operates several fleet maintenance and repair service facilities 12 ( "Fleet Service Centers ") for the purpose of routine maintenance and mechanical repair of City -owned 13 vehicles and mechanical equipment; and 14 WHEREAS, the Little Rock Housing Authority ( "Housing Authority ") does not own or operate a fleet 15 services facility and is interested in continuing its contractual relationship with the City for the 16 performance of such services at the City's Fleet Service Centers; and 17 WHEREAS, the additional fleet services responsibilities will not have significant impact on the 18 City's Fleet Service Center operations, and the additional cost to the City for labor and parts will be 19 reimbursed by the Housing Authority. 20 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE 21 ROCK, ARKANSAS: 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 Section 1. Pursuant to the authority set forth in Ark. Code Ann. S 25 -20 -108 (Michie Supp. 2007), the City Manager is authorized to execute a public agency service agreement, in a form to be approved by the City Attorney, in order to provide maintenance and repair services for Housing Authority vehicles and equipment for a five (5) year term with option to renew the term one time for an additional five (5) years. Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the resolution. Section 3. Repealer. All ordinances and resolutions are hereby repealed to the extent of such inconsistency.
