19818ORDINANCE NO. 19,818 AN ORDINANCE APPROVING A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED COMMERCIAL DISTRICT TITLED SCROGGINS SHORT -FORM PD -C (Z- 8241), LOCATED AT 3010 WINSOME DRIVE, LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zoning classification of the following described property be changed from R -2 to PD -C: All that part of the NE V4, Section 14, T -1 -N, R -14 -W, Pulaski County, Arkansas, more particularly described as follows: Commencing at the NE corner of said Section 14, thence N88 °42'20 "W along the north line thereof 1855.06 feet to a one inch diameter pipe, being the NW corner of Lot 10, Winsome Wood Subdivision, unrecorded, thence S 18 °30'29 "W along the west line of said Lot 10 for 150.66 feet to a two inch diameter pipe, thence S 18 °02' 5 8 "W along a fence line 491.06 feet to a two inch diameter pipe in the fence corner, thence S68 °32'55 "E along a fence line 11.73 feet to a rebar in a fence corner, and the point of beginning, thence N85 °59'07 "E leaving said fence 158.71 feet to a two inch diameter pipe, thence S52 °42'40 "E 330.41 feet to a two inch diameter pipe, thence S48 °53'46 "E 204.22 feet to a rebar in the westerly right of way line of Winsome Drive, thence S32'03'1 I "W 94.21 feet along said road right of way, thence N52 °59'58 "W leaving said road right of way 66 1. 10 feet to a rebar in a fence line, thence N28 °36'55 "E along said fence 6.05 feet to the point of beginning, containing 1.4704 acres more or less. SECTION 2. That the approval of Scroggins Short-form PD -C (Z- 8241), located at 3010 Winsome Drive is subject to compliance with the following additional conditions: • That the preliminary site development plan/plat be approved as submitted, including all staff comments and conditions as outlined in the Planning Commission Agenda Staff Report in paragraphs D, E, F and including any conditions indicated in the staff analysis in paragraph H and subject to additional conditions imposed at the Planning Commission Public Hearing as amended by the applicant. • The approval is limited to the applicant's ownership of the business and his occupancy of the site as a residence and is not transferable to any future property owner. • The applicant is not allowed any employees other than a family member. SECTION 3. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 4. That the change in zoning classification contemplated for Scroggins Short- form PD -C (Z- 8241), located at 3010 Winsome Drive is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 6. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
