CODE §28 -28 (1988) TO MODIFY THE RATES FOR SOLID WASTE COLLECTION SERVICES; TO DECLARE AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, in Little Rock, Ark., Resolution No. 11,171 (December 4, 2001), the Board of Directors authorized the issuance of a City solid waste revenue bond issue, and WHEREAS, as part of the bond issue the City covenanted to charge and collect rates sufficient to pay for solid waste operations, and WHEREAS, the current monthly rate of $18.91 is insufficient to maintain solid waste operations at current service levels, and WHEREAS, the Board has determined current solid waste service levels should be maintained, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. Little Rock, Ark., Rev. Code § 28 -28 (1988) is hereby amended to read as follows: (a) Each dwelling unit will be charged without exception the sum of twenty dollars and ninety-nine cents ($20.99) per month. Each billing unit will be provided a single city owned solid waste container (supercart). Fees shall be collected monthly and may be billed on the statement for water for said premises, or some other similar system approved by the City Manager, and shall be the debt and obligation of the person, firm or corporation in whose name the water meter is listed. In the event any title, section, paragraph, item, sentence, 2 clause, phrase, or word of this ordinance is declared or adjudged to be invalid or 3 unconstitutional, such declaration or adjudication shall not affect the remaining portions of 4 the ordinance which shall remain in full force and effect as if the portion so declared or 5 adjudged invalid or unconstitutional was not originally a part of the ordinance. 6 Section 3. Repealer. All ordinances and resolutions, and parts thereof, which are in 7 conflict with any provision of this ordinance are hereby repealed to the extent of such 8 conflict. 9 Section 4. Effective Date. SECTION 2. Repealer. All laws, ordinances and regulations and parts thereof in conflict with this ordinance are hereby repealed to the extent of such inconsistency. SECTION 3. Severabiliry. In the event any portion of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration and adjudication shall not affect the remaining portions of the ordinance, which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally apart of this ordinance.
