189530 • 1 ORDINANCE NO. 18,953 2 3 AN ORDINANCE TO WAIVE COMPETITIVE BIDS AND 4 AUTHORIZE THE CITY MANAGER TO ENTER INTO A SERVICE 5 AGREEMENT WITH MOTOROLA IN THE AMOUNT OF $381,205 AS 6 A SOLE SOURCE PROVIDER OF MAINTENANCE FOR CITY'S 800 7 MHZ RADIO SYSTEM. H 9 WHEREAS, Motorola has provided the maintenance for the City's 800 MHZ 10 system for ten years; and 11 WHEREAS, the Motorola radio system has proprietary design features that are 12 very important when it comes to considering maintenance; and 13 WHEREAS, Motorola's Smartnet Trunking protocol requires unique test 14 equipment capable of decoding and encoding Motorola digital voice privacy secure 15 communications; and 16 WHEREAS, Gram Communications Company of North Little Rock is the only 17 communications company in the central Arkansas area which has the trained personnel, 18 proprietary software and test equipment available to properly maintain the City's 19 system and is the service provider for Motorola. 20 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 21 OF THE CITY OF LITTLE ROCK, ARKANSAS: 22 Section 1. The City Manager is authorized to enter into a service agreement 23 with Motorola in the amount of $381,205 to provide maintenance on the City's 800 24 MHZ radio system with the option to extend for five (5) years with pricing, terms and 25 conditions remaining the same for the first, second, and third year of the contract. The 26 fourth and fifth years shall be subject to changes due to any consumer price increases. [PAGE 1 OF 21 Ordinance To authorize service agreement for City WO MHZ Radio System 0 n u 1 Section 2. The City Manager is authorized to waive competitive bidding and 2 declare Motorola as a sole source provider of maintenance for the City's 800 MHZ radio 3 system in order to ensure proper maintenance of the City's system. 4 Section 3. Funds are available in the 911 Fund (250- 350 - 1445). 5 Section 4. Severability. In the event any title, section, subsection, subdivision, 6 paragraph, subparagraph, item, sentence, clause, phrase, or word of this ordinance is 7 declared or adjudged to be invalid or unconstitutional, such declaration or adjudication 8 shall not affect the remaining portions of the ordinance which shall remain in full force 9 and effect as if the portion so declared or adjudged invalid or unconstitutional was not 10 originally a part of the ordinance. 11 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same, 12 that are inconsistent with the provisions of this ordinance are hereby repealed to the 13 extent of such inconsistency. 14 Section 6. Emergency Clause.
