ORDINANCE NO. 18,939 Fees $11.00
AN ORDINANCE AMENDING CHAPTER 36 OF THE CODE
OF ORDINANCES OF THE CITY OF LITTLE ROCK,
ARKANSAS PROVIDING FOR MODIFICATION OF VARIOUS
REGULATIONS; AND FOR OTHER PURPOSES.
WHEREAS, facilities which provide residential treatment or temporary housing may
have an adverse impact on properties within the vicinity of such uses; and,
WHEREAS, it has been determined that such uses should be reviewed to determine the
appropriateness of locating them at specific sites; and,
WHEREAS, no currently approved such uses shall be made illegal by this action.
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. That Chapter 36., Section 36.3. be amended to provide for the insertion of
a new definition "homeless shelter" to read as follows:
Homeless shelter means a facility providing temporary housing to indigent, needy,
homeless or transient persons. Such a facility shall be permitted to also provide ancillary
services such as meals, counseling and vocational training.
SECTION 2. That Chapter 36., Section 36- 104.(a) be deleted in its entirety and replaced
with new text to read as follows:
(a) Due to their nature and impact on properties in the general vicinity, correctional
facilities, homeless shelters and any establishment of a religious, charitable or
philanthropic organization or any establishment for the care of alcoholic, narcotic
or psychiatric patients which provide residential treatment or temporary housing
shall require a conditional use permit in all zoning classifications.
SECTION 3. That Chapter 36., Section 36 -107. be amended to provide for the addition
of a new subsection (14) to read as follows:
(14) Separation, spacing and procedural requirements for homeless shelters
and establishments of a religious, charitable or philanthropic
organization or establishment for the care of alcoholic, narcotic or
psychiatric patients which provide residential treatment or temporary
housing will be determined by the Planning Commission so as not to
adversely impact the surrounding properties and neighborhood. Unless
the Commission determines that a different area is more appropriate ,at' "2264 °pPRY°°

will consider during its review of such facilities include, but are not
limited to:
a) Spacing of existing similar facilities
b) Existing zoning and land use pattern
C) The maximum number of individuals proposed to be served, the
number of employees proposed and type of services being
proposed
d) Provisions for readily accessible public or quasi - public
transportation
e) Access to support services such as social services agencies,
employment agencies and medical service providers
SECTION 4. Severability. In the event any title, section, paragraph, item, sentence,
clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional,
such declaration or adjudication shall not affect the remaining portions of the ordinance which
shall remain in full force and effect as if the portion so declared or adjudged invalid or
unconstitutional was not originally a part of the ordinance.
SECTION 5. Repealer. All laws, ordinances, resolutions, or parts of the same, that are
inconsistent with the provisions of this ordinance are hereby repealed to the extent of such
inconsistency.
SECTION 6. Emergency. The Board of Directors hereby finds and declares that as a
result of the current development pressures it is necessary to implement these regulations. In
order to protect and preserve the health, safety and welfare of the citizens of the City, an
emergency is hereby declared to exist and this ordinance shall be in effect immediately upon its
passage.
