AN ORDINANCE TO VACATE AND ABANDON A SANITARY
SEWER EASEMENT LOCATED IN BLOCK 11, FERNDALE
ADDITION, IN THE CITY OF LITTLE ROCK, ARKANSAS; AND
FOR OTHER PURPOSES.
8 Whereas, a request was made by the owner of the property mentioned herein to
9 abandon the sanitary sewer easement described below pursuant to its general police
10 power authority under Ark. Code Ann. § 14 -54 -104;
11 Whereas, the Board has determined that the easement herein is located entirely
12 within the applicant's property and abandoning of the easement will not have an
13 adverse impact on the adjacent property owners nor the public welfare and safety, and
14 therefore, the sanitary sewer easement to be abandoned by this ordinance is no longer
15 needed for corporate purposes.
16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
17 OF THE CITY OF LITTLE ROCK, ARKANSAS:
18 Section 1. The Board of Directors hereby releases, vacates, and abandons the
19 sanitary sewer easement of the City of Little Rock located on the North and East sides of
20 710 Jones Street, in Block 11, Ferndale Addition, in the City of Little Rock, Pulaski
21 County, Arkansas.
22 Section 2. A copy of this ordinance duly certified by the,City Clerk, shall be
23 filed in the real estate records of the recorder of the Circuit, C£erk,D 18-- x,gfficio recorder

RESOLUTION NO. 2003 - 05
A RESOLUTION RECOMMENDING AND CONSENTING THAT A
CERTAIN SANITARY SEWER EASEMENT IN FAVOR OF THE CITY
OF LITTLE ROCK FOR THE USE AND BENEFIT OF THE LITTLE
ROCK SANITARY SEWER COMMITTEE LOCATED ON PARTS OF LOTS
13, 14, 15, 16, 17, AND 18, BLOCK ELEVEN (11),
FERNDALE ADDITION TO THE CITY OF LITTLE ROCK BE
ABANDONED
WHEREAS, there now exists a sanitary sewer easement in
favor of the City of Little Rock for the use and benefit of
Little Rock Sanitary Sewer Committee acquired by Little Rock
Sanitary Sewer Committee on December 20, 2000 in Pulaski County
Circuit Court and recorded as Document 2000089972 located on
parts of Lots 13, 14, 15, 16, 17, and 18, Block Eleven (11),
Ferndale Addition to the City of Little Rock being more
specifically described as a sewer easement beginning at the NW
corner of Lot 18; thence easterly 140.0' along the north lot
line of Lot 18 to the NE corner of Lot 18; thence southerly
295.0' along the east lot lines to the SE corner of Lot 13;
thence westerly 9.7' along the south lot line of Lot 13; thence
northerly 285.0' to a point that is 10.0' south and 16.1' west
of the NE corner of Lot 18; thence westerly 123.9' to a point on
the west lot line of Lot 18 that is 9.0' south of the NW corner
of Lot 18; thence northerly 9.0' along the west lot line of Lot
18 to the point of beginning, containing 4956 square feet, more
or less; and
WHEREAS, William David Duke, Attorney for Jones Street, LLC
has requested that said sanitary sewer easement in favor of the
City of Little Rock be abandoned; and,
WHEREAS, the Little Rock Sanitary Sewer Committee and the
Little Rock Wastewater Utility have no present or future need
for said sanitary sewer easement;
NOW, THEREFORE, BE IT RESOLVED by the Little Rock Sanitary
Sewer Committee of the City of Little Rock, Arkansas, that the
Sewer Committee hereby recommends that the sanitary sewer
easement in favor of the City of Little Rock for the use and
benefit of Little Rock Sanitary Sewer Committee acquired on
December 20, 2000 in Pulaski County Circuit Court and recorded
0 0
as Document 2000089972 located on parts of Lots 13, 14, 15, 16,
17, and 18, Block Eleven (11), Ferndale Addition to the City of
Little Rock, insofar as it relates to any use or purpose as a
sewer easement, should be abandoned and therefore, the Sewer
Committee consents for the Little Rock Board of Directors to
vacate this easement and take all necessary actions in
connection therewith.
THIS RESOLUTION, shall be in full force and effect from and
after its adoption and approval.
