AN ORDINANCE APPROVING A PLANNED ZONING
DEVELOPMENT AND ESTABLISHING A PLANNED
OFFICE DISTRICT TITLED MALMSTORM SHORT -FORM
POD (Z -7433) LOCATED AT THE NORTHWEST CORNER
OF KANIS ROAD AND AUTUMN ROAD, IN THE CITY OF
LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL
ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR
OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That the zoning classification of the following described property
be changed from R -2 and 0-3 to POD:
Tract 3, except the North 212 feet thereof, of Montclair Subdivision, being
a subdivision of the S %z SW '/<, Section 4, T -1 -N, R -13 -W, now in the
City of Little Rock.
Part of Tract 4 of the Montclair Subdivision in the City of Little Rock,
Pulaski County, Arkansas, located in Section 4, Township 1 North, Range
13 West and recorded in Plat Book 3, Page 137, being described as
follows; beginning at the southeast corner of said Tract 4, thence north
along the east line of said Tract a distance of 400.0 feet; thence North 88
degrees 19 minutes west parallel to the south line of said Tract a distance
of 60.0 feet; thence South parallel to the east line of said Tract a distance
of 400.0 feet to the north right of way line of Kanis Road and the South
line of said Tract; thence South 88 degrees 19 minutes east along said
right of way line a distance of 60.0 feet to the point of beginning.
Together with a 10 foot wide sanitary sewer easement being part of Tract
4 of the Montclair Subdivision of the south one half of the southwest one
quarter of Section 4, Township 1 North Range 13 West in the City of
Little Rock, Pulaski County, Arkansas; said easement being 5 feet each
side of a line, described as follows: Commencing at the southeast corner
of the above said Tract 4; thence north 89 degrees 59 minutes 35 seconds
west, along the south line of the above said Tract 4, 59.87 feet; thence
north 1 degree 42 minutes 52 seconds east, 48.14 feet to the point of
beginning; thence north 11 degrees 01 minutes 09 seconds west 40.03 feet;
thence south 88 degrees 17 minutes 08 seconds east, 6.47 feet. .,,,

SECTION 3. That the change 'in zoning classification contemplated for
Malmstorm Short-form POD is conditioned upon obtaining a final plan approval within
the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of
Ordinances.
SECTION 4. That the map referred to in Chapter 36 of the Code of Ordinances
of the City of Little Rock, Arkansas, and designated district map be and is hereby
amended to the extent and in the respects necessary to affect and designate the change
provided for in Section 1 hereof.
SECTION 5. That this Ordinance shall not take effect and be in full force until
the final approval of the plan.
SECTION 6. Severability. In the event any title, section, paragraph, item,
sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
or unconstitutional, such declaration or adjudication shall not affect the remaining
portions of the ordinance which shall remain in full force and effect as if the portion so
declared or adjudged invalid or unconstitutional was not originally a part of the
ordinance.
SECTION 7. Repealer. All laws, ordinances, resolutions, or parts of the same
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.
