3 AN ORDINANCE AMENDING CHAPTERS 31 AND 36 OF THE
4 CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK,
5 ARKANSAS PROVIDING FOR MODIFICATION OF VARIOUS
6 PROCEDURES, DEFINITIONS, AND LAND USE
7 REGULATIONS, AND FOR OTHER PURPOSES.

9 WHEREAS, it has been determined by the Little Rock Planning Commission that
10 an annual review of these chapters is appropriate; and
11 WHEREAS, the Planning Commission has determined several modifications are
12 appropriate at this time. r
13 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
14 OF THE CITY OF LITTLE ROCK, ARKANSAS:
15 Section 1. That various provisions of Chapters 31 and 36 be amended as follows:
16 Subsection (a). That Chapter 36, Section 35- 54(e)(2)(e) be deleted in its entirety
17 and the remaining elements within that subsection be serially restructured accordingly.
18 Subsection (b). That Chapter 36, Section 36- 553(b) be deleted in its entirety and
19 replaced with new text to read as follows:
20 (b) All freestanding, projecting, and under - canopy signs shall have a
21 minimum setback of five (5) feet from any property line and vehicular
22 public right -of -way, measured from the closest edge of the sign, and a
23 minimum clearance of thirteen (13) feet over any vehicular use area.:and ......

25 greater than two hundred (200) footlamberts of luminance.

1 Subsection (c). That Chapter 36, Section 36- 346(f) be amended to correct an
2 incorrect reference and to then read as follows:
3 (f) Signage. Signage shall comply with the provisions of Article X. of this
4 Chapter, except as follows:
5 Subsection W. That Chapter 31, Section 31- 232(b) be amended to correct an
6 incorrect reference and to then read as follows:
7 (b) No residential lot shall be more than three (3) times as deep as it is
8 wide, except lots approved under paragraph(g) of this section. No lot
9 except lots designated for townhouse use shall average less than one
10 hundred (100) feet in depth. Lot width shall be measured at the building
I1 line except in the case of a lot abutting a cul -de -sac where the average
12 width of the lot shall be used.
13 Subsection W. That Chapter 36, Section 36- 342.1(c)(8) be amended to delete the
14 last paragraph with the resulting text being as follows:
15 (8) Street -level floor. The ground -level (street fronting) floor of
16 nonresidential structures shall have a minimum surface area of sixty (60)
17 percent transparent or window display.
18 Subsection (f). That Chapter 36, Section 36- 342.1(c)(11) be amended to correct
19 punctuation and to add a new sentence with the resulting text to read as follows:
20 (11) Signs. Off - premises, pole and monument signs are not allowed;
21 otherwise, permitted signs shall be as in section 36 -553, signs
22 permitted in institutional and office zones, of this chapter. On the
23 street level, the maximum area of signage may be doubled if at least
24 fifty (50) percent of the street -level office and retail space has direct
25 access to the street.

Subsection (g). That Chapter 36, Section 36- 342.1(e) be deleted in its entirety and
replaced with new text to read as follows:
(e) Height regulations. No building hereafter erected or structurally
altered shall exceed a height of five (5) stories or seventy-five (75) feet,
whichever is less. Developments which provide a minimum twenty (20)
percent of the gross floor area for residential uses are entitled to add two
(2) stories to the structure. Any structure which is certified by CATA
(Central Arkansas Transit Authority) as providing a portion of the
structure for mass transit (such as a bus stop, etc.) is entitled to one (1)
bonus floor. If at least fifty (50) percent of the street -level office and retail
space has direct access to the street, the total building square footage may
be increased with additional floor(s) at a rate of two (2) square feet for
each one (1) square foot of leaseable space directly accessible to the street.
All building height bonuses in this section are cumulative not to exceed
fifteen (15) stories or two hundred twenty-five (225) feet.
For those structures within the area described as, 2nd Street south to 911
Street and Scott Street west to Broadway, the maximum allowable
structural height shall be governed by the "Adams Field Airport Zoning
Ordinance" (Little Rock Code of Ordinances section 7 -57 [section 7 -51 et
seq.]).
Subsection W. That Chapter 36, Sections 36- 553(a)(2)c; 36- 554(a)(2)d.; and 36-
555(a)(2)d be deleted in their entirety.
Subsection W. That Chapter 36, Section 36 -557 be amended to provide for a new

1 (e) Within the institutional and office, commercial and industrial
2 districts, each premises may utilize incidental signs not to exceed twenty
3 (20) square feet in aggregate sign area per occupancy.
4 Subsection (j). That Chapter 36, Section 36- 342.1(c)(9)a be amended to provide
5 for the addition of new text and to then read as follows:
6 a. Objects shall not project from the building fagade over the
7 public right -of -way except for awnings, balconies and signs as
8 specified in Section 36 -553.
9 Subsection (k). That Chapter 36, Section 36- 302(c)(2) be amended to provide for
10 the insertion of a new conditional use to be item h. and the serial restructuring of items
11 h through 1 accordingly. The new use to read:
12 h. Other permitted and conditional uses in the C -3 district not
13 otherwise permitted in the C-4 district.
14 Subsection (1). That Chapter 36, Section 36- 342.1(b) be amended to provide for
15 the insertion of new text within the first paragraph of that section. The first paragraph
16 of that section to then read:
17 (b) Application of regulations. The regulations of this district shall apply
18 to new development, redevelopment exceeding fifty (50) percent of the
19 structure's current replacement value, and expansion of existing
20 development or exterior modifications. Routine repairs and maintenance
21 shall not require compliance with this section.
22 Subsection (m). That Chapter 31, Section 31 -89 be amended to provide for the
23 addition of new text within the first paragraph of that section. The first paragraph of
24 that section to then read:
25 A preliminary plat shall be submitted in the number of copies as
26 established by the planning commission. It shall be clearly and legibly

1 drawn and shall be submitted on white paper no larger than twenty-four
2 (24) inches by thirty-six (36) inches. Extra large plats may be submitted on
3 more than one (1) conforming sheet. Plat scale shall be one (1) inch equals
4 fifty (50) feet for plats up to and including ten (10) acres and one (1) inch
5 equals one hundred (100) feet for plats larger than ten (10) acres, except
6 where a smaller scale may be deemed appropriate by the staff. The
7 preliminary plat shall be identified by the name of the subdivision, and
8 shall include all information listed below. The preliminary plat shall also
9 be submitted in an electronic format compatible with equipment in the
10 Planning and Development Department of the City of Little Rock. Data
11 shall be in CAD compatible .DXF or .DWG (compatible with software
12 available in the Planning and Development Department of the City of
13 Little Rock) format containing the information listed below.
14 Subsection W. That Chapter 36, Section 36- 130(b)(1) be amended to provide for
15 the addition of new text and to read as follows:
16 (1) A site plan to be submitted on white paper no larger than twenty-
17 four (24) inches by thirty-six (36) inches, and no smaller than eleven
18 (11) inches by seventeen (17) inches, and including all information
19 listed below.
20 A site plan shall also be submitted in an electronic format compatible with
21 equipment in the Planning and Development Department of the City of Little
22 Rock. The data shall be in CAD compatible .DXF or .DWG (compatible with
23 software available in the Planning and Development Department of the City of
24 Little Rock) format containing all information listed below in separate layers.
25 Subsection W. That Chapter 36, Section 36 -298 be amended to provide for the
26 addition of a new subsection (8) to read as follows:

1 (8) Eating places (inside, with drive -in service and without drive -in
2 service) shall be permitted to have an area of outdoor dining subject
3 to compliance with the following provisions:
4 a. The area of outdoor dining shall not be located in the public right-
5 of -way nor shall it obstruct pedestrian movement, fire lanes,
6 access to any business or areas designated for access by the
7 physically impaired.
8 b. The number of seats in the area of outdoor dining shall not exceed
9 fifty (50) percent of the number of seats within the eating place.
10 c. On -site parking shall be provided for the area of outdoor dining
11 based on the parking space per square foot requirement for
12 restaurants established in section 36 -502.
13 d. Compliance with applicable state and county health regulations.
14 e. The area of outdoor dining shall not be located between the
15 building occupied by the eating place and adjacent residentially
16 zoned or used properties.
17 f. This subsection shall not be deemed to permit signage or
18 structural alterations such as canopies or walls regulated
19 elsewhere in this chapter.
20 Subsection (p). That Chapter 31, Section 31 -94(e) be deleted in its entirety and
21 replaced with new text to read as follows:
22 (e) A preliminary plat approved by the planning commission shall
23 be effective and binding upon the commission for two (2) years from the
24 date of approval or as long as work is actively progressing, at the end of
25 which time the final plat application for the subdivision must have been
26 submitted to the planning staff. Any plat not receiving final approval

within the period of time set forth herein or otherwise conforming to the
requirements of this chapter shall be null and void, and the developer
shall be required to submit a new plat of the property for preliminary
approval subject to all zoning restrictions and this chapter.
The planning commission may extend the original preliminary
approval, for a period not to exceed one (1) additional year, when it can be
demonstrated that there are no changes in the plat design or
neighborhood that warrant a complete review.
Subsection (q). That Chapter 36, Section 36- 511(a) be amended to correct a
typographical error and to provide for the addition of new text. The section to then
read:
Section 36 -511. Parking design.
(a) The following four (4) parking angles are allowed with their
respective width and depth dimensions for stalls and maneuvering areas:

For purposes of compact -car space design, the width of spaces may be
reduced to eight (8) feet six (6) inches. This design dimension

1 modification is permitted in those instances where a parking lot will
2 consist of a minimum of fifty (50) parking spaces upon completion of the
3 design whether located within a parking structure or an open parking
4 surface. The maximum number of compact spaces permitted in any
5 parking lot shall be limited to twenty (20) percent of the total spaces.
6 Spaces shall be measured between centerlines of painted stripes. These
7 spaces shall be properly signed or marked as compact -car use only. These
8 dimensions are specifically prohibited for use in handicapped or loading -
9 zone areas.
10 Within parking structures, compact spaces shall be permitted for all
11 45° and 60° angle parking spaces located on a one -way aisle or drive. All
12 other parking spaces shall have a width of nine (9) feet.
13 Subsection (r). That Chapter 36, Section 36 -557 be amended to provide for the
14 addition of a new subsection (e) to read as follows:
15 (e) All on- premises ground- mounted signs shall have located on the face
16 of the sign, in characters no less than six (6) inches in height, the
17 street address number of the business identified by the sign. In the
18 case of a double -faced ground - mounted sign, the street address
19 number shall be located on each face of the sign.
20 Subsection (s). That Chapter 36, Section 36- 252(3) be amended to provide for the
21 addition of new text and to then read as follows:
22 (3) In the R -2 and R -3 districts, one (1) of the dwelling units must be
23 occupied by the landowner.
24 Subsection (t). That the title of Section 36 -53 be amended to read as follows:

1 SECTION 2. Severability. In the event any title, section, paragraph, item, sentence,
2 clause, phrase, or word of this ordinance is declared or adjudged to be invalid or
3 unconstitutional, such declaration or adjudication shall not affect the remaining portions of
4 the ordinance which shall remain in full force and effect as if the portion so declared or
5 adjudged invalid or unconstitutional was not originally a part of the ordinance.
6 SECTION 3. Repealer. All laws, ordinances, resolutions, or parts of the same,
7 that are inconsistent with the provisions of this ordinance are hereby repealed to the
8 extent of such inconsistency.
9 SECTION 4. That this ordinance shall take effect thirty (30) days from and after
10 its passage.
