3 AN ORDINANCE ABANDONING AN EASEMENT FOR PUBLIC
4 UTILITY AND DRAINAGE PURPOSES RETAINED IN A
5 NORTH -SOUTH ALLEY VACATED IN LITTLE ROCK
6 ORDINANCE NO. 18,219 (FEBRUARY 15, 2000); AND FOR
7 OTHER PURPOSES.

9 WHEREAS, pursuant to Little Rock, Ark. Ordinance No. 18,219 (February
10 15, 2000), the City Board of Directors vacated and closed a north -south alley in
11 Block 4 of Mountain Park Addition to the City of Little Rock, Arkansas, after it
12 was no longer needed for public traffic purposes, and
13 WHEREAS, the ordinance vacating and closing said alley retained an
14 easement in the abandoned alley for public utility and drainage purposes, and
15 WHEREAS, the utility and drainage easement is not needed for utility and
16 drainage purposes because the Board of Directors passed Little Rock, Ark.
17 Ordinance No. 18,217 approving the Kroger PCD, and
18 WHEREAS, the unneeded utility and drainage easement should be
19 abandoned.
20 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
21 DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
22 Section 1. The existing utility and drainage easement retained in Little

1 Section 3. Severability. In the event any title, section, paragraph, item,
2 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be
3 invalid or unconstitutional, such declaration or adjudication shall not affect the
4 remaining portions of the ordinance, which shall remain in full force and effect
5 as if the portion so declared or adjudged invalid or unconstitutional was not
6 originally a part of the ordinance.
7 Section 4. Repealer. All ordinances, resolutions, bylaws, and other matters
s inconsistent with this ordinance are hereby repealed to the extent of such
9 inconsistency.
