AN ORDINANCE ESTABLISHING AN OVERLAY DISTRICT FOR
THE PRESIDENTIAL PARK AREA PURSUANT TO THE DESIGN
OVERLAY AUTHORITY OF CHAPTER 36 OF THE CODE OF
ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS; AND
FOR OTHER PURPOSES.
WHEREAS, regulation must be in place to protect the Presidential Park from the negative
impact of poorly planned or inappropriate projects, and;
WHEREAS, the City of Little Rock wishes to encourage the redevelopment of the areas
surrounding the Presidential Park, and;
WHEREAS, land speculation in the area surrounding the Presidential Park has already
commenced, and;
WHEREAS, the Little Rock Planning Commission recommends the use of an overlay to
allow time to a more thoroughly review of the area.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. Pursuant to Chapter 36 of the Code of Ordinances of the City of Little Rock, a
Design Overlay District for the Presidential Park area is hereby established as follows:
A. DISTRICT BOUNDARIES
Starting at I -30 and 7`h Street, hence East to College, hence North to 6`h
Street, hence East to Bond, hence North to Arkansas River, hence West to 1-
30, hence South to point of beginning, LESS and EXCEPT the Presidential
Park (zoned Park — PR).
B. APPLICATION OF DESIGN REGULATIONS
For new constructions or additions, development shall meet the Urban Use
�. Zoning District requirements rather than the current zoning for properties
within the district. Except that the maximum height which shall not exceed
two - stories or 35 feet.
A development that does not or cannot meet these requirements must be
submitted as a Planned Zoning District (PZD). The Planning Commission Cl
shall review the PZD proposal to assure it meets the spirit of the overlay,
compliments the Presidential Park area, does not hide or overshadow th O ;" ,
Presidential Park, and does not introduce, expand or continue a
or impact on the Presidential Park.
C. REVIEW SECTION
The Director of the Department of Planning and Development shall determine
compliance of all building pen-nit requests within the boundaries of the
Presidential Park Overlay.
D. EXCEPTIONS
Requests for new construction that do not comply with the design regulations
of this section as determined by staff must be submitted as a Planned Zoning
District before the Little Rock Planning Commission.
SECTION 2. Severability. This ordinance and its various parts are hereby declared to be
severable. If any section, clause, provision or portion of this ordinance is declared invalid or
unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of this
ordinance as a whole. All parts not declared invalid or unconstitutional shall remain in full force and
effect.
SECTION 3. This Ordinance shall be in effect until .January 1, 2004. After said date, all
requirements of this ordinance shall cease.
SECTION 4. Emergency. The Board of Directors hereby finds and declares that as a result
of the current development pressure in the Presidential Park area, that it is necessary to implement
these regulations in order to allow sufficient time to review the area and develop final zoning and
design regulations to protect the significance of this national site of importance. In order to protect
and preserve the health, safety and welfare of the citizens of the City, an emergency is hereby
declared to exist and this ordinance shall be in effect immediately upon its passage.
