3 AN ORDINANCE TO AMEND CHAPTER 17, ARTICLE II OF THE
4 LITTLE ROCK CODE, 1988, TO SIMPLIFY THE CALCULATION OF
5 BUSINESS LICENSE INVENTORY FEES; AMENDING EXISTING
6 BUSINESS CLASSIFICATIONS; DECLARING AN EMERGENCY; AND
7 FOR OTHER PURPOSES.

9 WHEREAS, the current method used to calculate inventory fees for a Little Rock
10 business license is easily misunderstood by licensees; and
11 WHEREAS, the required fee of one half of one (5) percent of the value of the business'
12 stock or inventory has been adjusted by a consumer price index over a period of several years,
13 and is now at an effective rate of twenty four hundredths of one (24) percent of the value of the
14 business' stock or inventory; and
15 WHEREAS, it has been determined that the consumer price index is not an appropriate
16 formula for adjusting inventory fees and that specific adjustments to such fees should be made as
17 economic conditions dictate; and
18 WHEREAS, simplification of the method used to calculate inventory fees and
19 clarification of the fee collection process will make the business license enforcement process
20 more efficient.
21 NOW THEREFORE, BE 1T ORDAINED BY THE BOARD OF DIRECTORS OF
22 THE CITY OF LITTLE ROCK, ARKANSAS:
23 Section 1. Section 17 -44(c) of the Little Rock City Code, 1988, is hereby amended to
24 read as follows:
25 (c) The business license fee is calculated by multiplying the average of
26 stock or inventory, or the beginning inventory amount for a new business,
27 by twenty four hundredths of one (.24) percent.
28 Section 2. Section 17 -45 of the Little Rock City Code, 1988, is hereby amended to add
29 subsection (5) as follows
30 (5) Business taxes payable in 2003 are due January 31, 2003, if paid
31 annually. The proprietor shall have the option of paying the annual tax in
32 two (2) equal installments on January 31, 2003 and July 1, 2003.

1 Section 3. Section 14 -52 of the Little Rock City Code, 1988, is hereby amended to
2 repeal business classification number 99.4 "Financial Consultant Services" in its entirety.
3 Section 4. The City Clerk shall publish this ordinance one time in a local newspaper no
4 later than one (1) week after the passage of the ordinance, as required in Ark. Code Ann. § 26-
5 77 -104 (Michie Repl. 2000 & Supp. 2001).
6 Section 5. Repealer. All ordinances and parts of ordinances that conflict with this
7 ordinance are hereby repealed to the extent of such inconsistency.
8 Section 6. Severability. In the event that any title, section, item, sentence, clause,
9 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
10 declaration or adjudication shall not affect the remaining portions of the ordinance which shall
11 remain in full force and effect as if the portion so declared or adjudged invalid or
12 unconstitutional was not originally a part of the ordinance.
13 Section 7. Emergency. The Board of Directors has previously declared that the
14 collection of business license fees is necessary for the performance of essential municipal
15 functions and that, without the same, the delivery of City services will decrease, and the City's
16 ability to provide and support the public peace, health and safety will be diminished. To ensure
17 that licensees receive their tax statements in time to meet the January fee collection deadline, this
18 Ordinance should be given effect immediately. An emergency is, therefore, declared to exist
19 and this ordinance shall be in full force and effect from and after the date of its passage.
