AN ORDINANCE VACATING AND ABANDONING A
PORTION OF ARCH STREET BETWEEN CAPITOL AVENUE
AND 4TH STREET IN THE CITY OF LITTLE ROCK ARKANSAS
WHEREAS, the United States General Services Administration submitted
a petition to close a portion of Arch Street between Capitol Avenue and 41" Street;
Me
WHEREAS, the United States government owns all property adjoining
the proposed street closure; and
WHEREAS, the Little Rock Board of Directors held a public hearing on
October 15, 2002 to determine whether this portion of Arch Street was needed for
corporate purposes; and
WHEREAS, based on information presented at the hearing, the Board of
Directors determined that closing this portion of Arch Street will not have an
adverse impact on the local traffic, since adjacent streets can adequately carry the
traffic flow through downtown Little Rock; and
WHEREAS, based on information presented at the hearing, the Board of
Directors determined that closing a portion of Arch Street to facilitate expansion
of the U.S. Post Office — Federal Courthouse complex, would benefit the public
interest and welfare; and
WHEREAS, all local utility companies have been notified of the proposed
street closure and have submitted their written consent to abandonment of the
public right -of -way, with Reliant Energy Arkla requesting a temporary easement
reservation pending relocation of their two -inch gas main.

Section 1. Subject to a temporary utility easement reservation by the
City, the Board of Directors hereby releases, vacates, and abandons all of the
right of the City of Little Rock, together with the right of the public in general, in
and to the public right -of -way described as follows:
All that part of Arch Street lying westerly of Block 117, Original
City of Little Rock, Pulaski County, Arkansas and northerly of
Capitol Avenue and Southerly of 4th Street, now appearing of
record in Deed Record L, Page 490, and more particularly
described as:
Beginning at an "X" in concrete at the Northwest corner of Block
117, Original City of Little Rock:
Thence S 9° 26' 57" W along the West line of said Block 117 for
300.06 feet to the Southwest corner of said Block 117;
Thence N 80° 29' 33" W for 59.79 feet to an "X" in concrete at the
Southeast corner of Block 126 of said Original City of Little Rock;
Thence N 9° 26' 57" E along the East line of said Block 126 for
300.05 feet to an "X" in concrete at the Northeast corner of said
Block 126;
Thence S 80° 29' 59" E for 59.79 feet to the Point of Beginning,
containing 17,940 square feet or 0.412 acres, more or less.
Section 2. The City specifically retains the right to use, and allow
others to use, the former street right -of -way as a temporary utility easement until
the existing gas main is relocated to the satisfaction of Reliant Energy Arkla.
Section 3. The Mayor and City Clerk are hereby authorized to execute
a deed and any other documents approved by the City Attorney to convey the
City's fee interest in the abandoned right -of -way to the United States
Government, pursuant to Arkansas Code § 14-54 -302.
Section 4. A copy of this ordinance duly certified by the City Clerk,
and the deed of conveyance shall be filed in the real estate records of the recorder
of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas.

Section 5. Severability. In the event any title, section, item, sentence,
clause, phrase, or word of this ordinance is declared or adjudged to be invalid or
unconstitutional, such declaration or adjudication shall not affect the remaining
portions of the ordinance which shall remain in full force and effect as if the
portion so declared or adjudged invalid or unconstitutional was not originally a
part of the ordinance.
Section 6. Repealer. All ordinances and resolutions inconsistent with
this ordinance are hereby repealed to the extent of such inconsistency.

Grantor, for the same consideration, grants, bargains, sells and conveys
to Grantee, WITHOUT EXPRESS OR IMPLIED WARRANTY, any right, title and
interest of Grantor in and to: (1) all streets, ways, strips, or gores, abutting,
adjoining or pertaining to the described tract of land, (ii) all mineral rights, riparian
rights and easements, and (iii) any adjacent streams and stream beds
Grantor QUITCLAIMS to Grantee the Easterly half of the alley adjacent to
the Westerly lot lines of Lots 7, 8, 9, 10, 11, and 12,.
The warranty of title applies to Lots 7, 8, 9, 10, 11, and 12 of Block 117,
Original City of Little Rock and the warranty of title does not apply to the Easterly
half of the alley adjacent to the Westerly lot lines of Lots 7, 8, 9, 10, 11, and 12.
