18745I ORDINANCE NO. 18,745 2 AN ORDINANCE TO WAIVE COMPETITIVE BIDDING 3 AND TO AUTHORIZE THE CITY MANAGER TO ENTER 4 INTO A CONTRACT WITH WILLIAM F. HECKER, JR. 5 AIA, OF BIRMINGHAM, ALA, FOR AN AMOUNT NOT 6 TO EXCEED $4,000 PAYABLE FROM THE CITY'S 7 AMERICAN'S WITH DISABILITIES ACCOUNT, FOR 8 TECHNICAL ASSISTANCE REGARDING THE CITY'S 15 9 YEAR CURB RAMP CONSTRUCTION PROGRAM; AND 10 FOR OTHER PURPOSES. 11 12 WHEREAS, the Board of Directors may dispense with the requirement of 13 competitive bidding in exceptional situations where such procedure is 14 impractical and unfeasible, and 15 WHEREAS, William F. Hecker, Jr., AIA, is a nationally recognized expert 16 on accessible design who also serves as Chair of the Curb Ramp Subcommittee 17 on the Public Rights -of Way Advisory Committee to the US Access Board, 18 Washington, D.C. ; and 19 WHEREAS, the City desires to contract with Mr. Hecker to provide 20 technical assistance for its ongoing 15 year curb ramp construction program, to 21 provide quality assurance and an update on the latest requirements for accessible 22 design for curb ramps. 23 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF 24 DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: [PAGE 1 OF 21 Ordinance Sole Source Wm. Hecker t 1 Section 1. The Board of Directors hereby finds that competitive bidding for 2 technical assistance for quality assurance and the latest information on curb ramp 3 design is impractical and unfeasible and should be waived in this case. 4 Section 2. The City Manager is authorized to enter into a contract with William 5 F. Hecker, Jr. as a sole source provider in an amount not to exceed four thousand dollars 6 ($4,000). 7 Section 3. Funding in the amount of up to four thousand dollars ($4,000) is S available from the Americans with Disabilities Act ( "ADA ") account. 9 Section 4. Severability. In the event any title, section, paragraph, item, 10 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid ii or unconstitutional, such declaration or adjudication shall not affect the remaining 12 portions of the ordinance which shall remain in full force and effect as if the portion so 13 declared or adjudged invalid or unconstitutional was not originally a part of the 14 ordinance. 15 Section 5. Repealer.
