AN ORDINANCE VACATING A PUBLIC UTILITY EASEMENT IN BLOCK 1
AND 2 OF SYDNEY J. JOHNSON'S ADDITION (ABIGAIL STREET BETWEEN
WEST 12TH AND 13TH STREET TO THE CITY OF LITTLE ROCK, ARKANSAS.
WHEREAS, a petition was duly filed with the Board of Directors of the City of Little
Rock, Arkansas on the 9`h day of April, 2002, asking the Board of Directors to vacate all
that portion of the public utility easement designated on the plat of the Sydney J.
Johnson's Addition to the City of Little Rock, Arkansas, now appearing of record in Plat
Book A -B, Page 282, in the Office of the Recorder of Pulaski County, Arkansas.
WHEREAS, after due notice as required by law, the Board of Directors has, at the time
and place mentioned in the notice, heard all persons desiring to be heard on the question
and as ascertained that the easement, or portion thereof, herembefore described, has
heretofore been dedicated to the public use as a utility easement herein described; has not
been actually used by the public generally for a period of at least five (5) years
subsequent to the filing of the plat; that all the owners of he property abutting upon the
portion of the utility easement to be vacated have filed wit the Board their written consent
to this action; and that public interest and welfare ill not be adversely affected by the
vacating of the utility easement.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The city of Little Rock, Arkansas releases, vacates and abandons all its
rights, together with the rights of the public generally, in and to the utility easement
designed as follows:
All of Block 1 and lots 1 , 2 and 12 in Block 2 of S. J. Johnson's Addition to the City
of Little Rock, and all of the alley, now closed in Block 1 and all of Abigail Street,
now closed, lying between Blocks 1 and 2 and all of the alley, now closed, lying
between Lots 1 and 12 in Block 12 of S. J. Johnson's Addition to the City of Little
Rock, Pulaski County, Arkansas.
SECTION 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in
the office of the Recorder of Pulaski County and recorded in the records of the County.
SECTION 3. This ordinance shall take effect and be in force from and after its passage
