18667• • 1 ORDINANCE NO. 18,667 2 3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK., REV. CODE § 2 -243 TO 4 IDENTIFY VETERINARIAN SERVICES AS A PROFESSIONAL SERVICE; AND FOR 5 6 OTHER PURPOSES. 7 WHEREAS, state statute permits the City to select certain services through a 8 competitive process that is not limited to choosing the lowest priced responsible and 9 responsive bid, and 10 WHEREAS, this same statutory scheme - Ark. Code Ann. §§ 19- 11-801 to -806 11 (Michie Repl. 1998) - permits a municipal corporation to define a particular service as a 12 professional service as long as the ordinance which makes this definition is read at two 13 distinct regular meetings of the governing body, and the ordinance is adopted without an 14 emergency clause, and 15 WHEREAS, the Board of Governors of the Little Rock Zoo has determined that it is 16 in the City's best interest to define the exotic veterinarian services needed for the Zoo as a 17 professional service, and 18 WHEREAS, because of proposed modifications to the City s Animal Services 19 Division it may be necessary at some point for the City to hire professional veterinarian 20 services, 21 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 22 THE CITY OF LITTLE ROCK, ARKANSAS: [PAGE 1 OF 21 Ordinance Designation of veterinarian as a professional service I Section 1. Little Rock, Ark., Rev. Code § 2 -243 (a) (2) (1988) is hereby amended to 2 add the following to the list of professional services that can be performed on behalf of the 3 city, its boards, commissions, or authorities: 4 Veterinarian services which can include selected on the basis of exotic 5 animal veterinarian services for entities such as the Little Rock Zoo, or 6 on the basis of typical veterinarian services for domesticated animals. 7 Section 2. Severability. In the event any title, section, paragraph, item, sentence, S clause, phrase, or word of this ordinance is declared or adjudged to be invalid or 9 unconstitutional, such declaration or adjudication shall not affect the remaining portions to of the ordinance which shall remain in full force and effect as if the portion so declared or 11 adjudged invalid or unconstitutional was not originally a part of the ordinance. 12 Section 3. Repealer.
