AN ORDINANCE VACATING AND CLOSING A PORTION OF
SOUTH KATILLUS STREET, LITTLE ROCK, PULASKI COUNTY.
WHEREAS, a petition was duly re -filed with the Little Rock City Clerk on 6'h Day of
December , 2001 asking the Little Rock Board of Directors to vacate, close and abandon
the South terminus of South Katillus Road, filed in Record Book 67 at page 307 in the
Pulaski County Court records.
WHEREAS, after due notice as required by law, the Board of Directors has, at the time
and place mentioned in the notice, heard all persons desiring to be heard on the question
and has ascertained that the street hereinbefore described, as been dedicated to the public
use as a street herein described, has been dedicated to the public use as a street, that all
owners of the property abutting upon the portion of the street to be vacated have filed
with the City Clerk, their written consent to the abandonment; and
WHEREAS, the public interest and welfare will not be adversely affected the
abandonment; and
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. Except as stated in Section 2 below, the City of Little Rock,
Arkansas, herby releases, vacated and abandons its rights, together with the rights of the
public generally, in and to the street designated as follows:

Part of the SW '/4 NW '/4 and Part of the SE 1/4 NW '/4 of Section 24, T -2 -N, R-
14-W, Little Rock, Pulaski County, Arkansas more particularly described as
follows: Starting at the Northeast corner of said SW '/4 NW '/4; thence S 01
degrees 34'48" W along the East Line of said SW '/4 NW/4,879.58 ft. to the
point of beginning; thence S 87 degrees 51' 55" E, 14.86 ft; thence S 02
degrees 08' 05" W along the East right -of -way line of South Katilius Road,
92.21 ft.; thence N 87 degrees 51' 55" W along the South right -of -way line of
said South Katilius Road, 92.21 ft.; thence N 87degrees 51 "55" W along`the
South right -of -way line of said South Katilius Road, 50.00 ft; thence N'•42
degrees 08' 05" E along the West right -of -way line of South Katilius Road;
92.21 ft; thence S 87 degrees 51" 55" E, 35.14 ft. to point o beginning;
containing 4,610 square feet more or less;

SECTION 2. The City specifically retains the right to use, and allow others to use, a
portion of the former street right of way as a public utility and drainage easement as
follows: The original 30 foot right -of -way along the Western boundary of Block 20,
Bellevue Addition is retained as a public utility and drainage easement. The remaining
10 foot right of way dedication made along the Eastern boundary of Lot 1, Gibby
Addition is to be abandoned with no easement rights retained.
SECTION 3. Abutting owners of record, receiving title to the abandoned right of way
and easement shall at their cost remove all vestiges of public use and access as my exist;
such modifications shall include, but are not limited to the following:
A. The entrances on both ends of the abandoned right of way and easement shall be
offset and/or rebuilt to conform to the standard driveway design as required by
Little Rock, Ark. Code Sec. 30 -26 -50 (1988).
B. The edge of pavement of the right of way shall be rebuilt to conform to existing
conditions in the general vicinity where the abandoned right of way and easement
intersects with the remaining public right of way.
SECTION 4. A copy of this ordinance duly certified by the City Clerk, shall be filed in
the office of the Recorder of Pulaski County and recorded in the records of the County.
SECTION 5. This ordinance shall take effect and be in force from and after its passage
and approval.
