186140 0 1 ORDINANCE NO. 18,614 2 3 AN ORDINANCE TO AMEND SECTION 34 -20 (a) OF THE 4 LITTLE ROCK TRANSPORTATION CODE, CODIFIED AT 5 LITTLE ROCK, ARK., REV. CODE § 34-1 TO § 34-97 (1988), TO 6 PROVIDE THAT SPECIALIZED TRANSPORTATION SERVICE 7 PROVIDERS SHALL HAVE AUTOMOBILE INSURANCE IN 8 THE AMOUNTS OF $10,000 FOR THE INJURY OR DEATH OF 9 ANY ONE PERSON AND SUBJECT TO THAT LIMIT FOR EACH 10 PERSON, $300,000 MAXIMUM LIABILITY FOR EACH 11 ACCIDENT, AND $100,000 FOR EACH ACCIDENT 12 REGARDING DAMAGE TO PROPERTY, DECLARING AN 13 EMERGENCY; AND FOR OTHER PURPOSES. 14 15 WHEREAS, On November 18, 1997, the City adopted a new 16 Transportation Code, codified at Little Rock, Ark., Rev. Code ( "LRC") § 34 -1 to 17 § 34 -97, that governs transportation franchises of vehicles for hire, and 18 WHEREAS, there is now a desire to amend Section 34 -20(a) of the 19 Transportation Code to provide that Specialized Transportation Service 20 providers shall have automobile insurance in the amounts of one hundred 21 thousand dollars ($100,000.00) for the injury or death of any one (1) person and 22 subject to that limit for each person; three hundred thousand dollars 23 ($300,000.00) maximum liability for each accident; and one hundred thousand 24 dollars ($100,000.00) for each accident regarding damage to property. 25 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF 26 DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: [PAGE 1 OF 31 Ordinance Amend Transportation Code 0 0 1 Section 1. LRC § 34 -20(a) shall be amended to add the following 2 subparagraph: 3 (4) For specialized transportation service: one 4 hundred thousand dollars ($100,000.00) for the 5 injury or death of any one (1) person and subject to 6 that limit for each person; three hundred thousand 7 dollars ($300,000.00) maximum liability for each 8 accident; and one hundred thousand dollars 9 ($100,000.00) for each accident regarding damage to 10 property. 11 Section 2. Repealer. All ordinances, resolutions, laws or policies, or 12 parts of any such material, in conflict with the provisions of this ordinance are 13 hereby repealed to the extent of such inconsistency. 14 Section 3. Severability. In the event any section, subsection, 15 subdivision, paragraph, subparagraph, item, sentence, clause, phrase, or word of 16 this ordinance is declared or adjudged to be invalid or unconstitutional, such 17 declaration or adjudication shall not affect the remaining provisions of this 18 ordinance, as if such invalid or unconstitutional provision was not originally a 19 part of this ordinance. 20 Section 4. Emergency Clause.
