AN ORDINANCE VACATING AND CLOSING AN ALLEY BETWEEN
PLATEAU AVENUE AND WEST 4TH STREET WITHIN BLOCK 5 OF
PLATEAU ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS
WHEREAS, a petition was duly filed wit the Little Rock City Clerk on 9th Day of
October, 2001 asking the Little Rock Board of Directors to vacate and abandon an alley
between Plateau Avenue and West 4`h Avenue, within Block 5 of Plateau Addition to the
City of Little Rock, Arkansas, as designated on the plat of said Addition now appearing
of record in Plat Book AB, Page 252, in the office of he Recorder of Pulaski County,
Arkansas; and
WHEREAS, after due notice as required by law, the Board of Directors has, at the time
and place mentioned in the notice, heard all persons desiring to be heard on the question
and has ascertained that the street hereinbefore described, as been dedicated to the public
use as a street, has not been actually used by the public generally for a period of at least
five (50 years subsequent to the filing of the plat; that all owners of the property abutting
upon the portion of the street to be vacated have filed with the City Clerk their written
consent to the abandonment; and
WHEREAS, the public interest and welfare will not be adversely affected the
abandonment; and
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. Except as stated in Section 2 below, the City of Little Rock,
Arkansas, herby releases, vacated and abandons its rights, together with the rights of the
public generally, in and to the street designated as follows: °p°oo°aunuu,

Commencing at the SW Corner of said Block 5; thence S 86 Degrees41'q (M�
the South line of said Block 5 a distance of 125.75 feet for the POINT OF no 006a00
BEGINNING; thence N 02 Degrees 09101" E. 400.14 feet; thence N 01
Degrees52 "39" E, 308.57 feet to the Southerly Right of way line of Plateau Avenue;
thence S 54 Degrees 25'54" E. Along Southerly Right of Way line 36.80 feet; thence
along a curve to the left having a Radius of 10.00 feet, an Arc Length of 21.48 feet
and a Chord bearing and distance of S 63 Degrees 15'14" W., 17.58 feet; thence S 01
Degrees 42'46" W, 280.17 feet; thence S 02 Degrees 09100" W, 400.09 feet to the

South line of said Block 5, also being the Northerly Right of Way line of West 4`h
Street; thence N 86 Degrees 41'48" W, along South line 16.00 feet to the POINT OF
BEGINNING, containing 0.257 Acres (11,205 sq. ft.) more or less.
SECTION 2. Abutting owners of record, receiving title to the abandoned right of way
and easement shall at their cost remove all vestiges of public use and access, as many
exist; such modifications shall include, but not limited to the following:
A. The entrances on both ends of the abandoned right -of -way and easement shall
be offset and/or rebuilt to conform to the standard driveway design as required
by Little rock, Arkansas Rev. Code Sec. 30 -26 -50 (1988).
B. The edge of pavement of the right -of -way shall be rebuilt to conform to
existing conditions in the general vicinity where the abandoned right -of -way
and easement intersects with the remaining public right of way.
SECTION 3. A copy of this ordinance, duly certified by the City Clerk, shall be filed in
the office of the Recorder of Pulaski County and recorded in the records of the County.
SECTION 4. This ordinance shall take effect and be in force from and after its passage
and approval.
