18576• 1 ORDINANCE NO. 1$576 2 3 AN ORDINANCE TO DEEM IMPROVEMENTS TO WATER FACILITIES 4 FOR THE GOVERNOR'S MANSION OF THE STATE OF ARKANSAS 5 TO BE A BENEFIT TO THE PUBLIC GOOD; TO AUTHORIZE SUCH 6 IMPROVEMENT TO FACILITIES; AND TO REQUIRE RELOCATION 7 OR IMPROVEMENT OF THE PUBLIC WORKS TO BE DONE AT THE s EXPENSE OF CENTRAL ARKANSAS WATER, TO DECLARE AN 9 EMERGENCY; AND FOR OTHER PURPOSES. 10 11 WHEREAS, the City has entered into a franchise agreement with Central Arkansas 12 Water (CAW) which requires the relocation of utility facilities at CAW expense if such 13 action is deemed by the Board of Directors to be an authorized project which will benefit 14 the public good, and 15 WHEREAS, there is currently in process an expansion of the Governor's Mansion 16 within the City, and this expansion effort impacts CAW facilities located on Louisiana 17 Street and may require certain work be done, or facilities relocated or modified as a result 1s of this project, 19 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 2a THE CITY OF LITTLE ROCK, ARKANSAS: 21 Section 1. The Board of Directors deems the expansion of the Governor's 22 Mansion in downtown Little Rock to be an authorized project that will benefit the public 23 good, and directs that any CAW facilities that need to be modified or relocated will occur 24 at utility expense pursuant to Section 1.5 of the City's franchise agreement with CAW. 25 Section 2. Severability. In the event any title, section, paragraph, item, sentence, 26 clause, phrase, or word of this ordinance is declared or adjudged to be invalid or 27 unconstitutional, such declaration or adjudication shall not affect the remaining portions [PAGE 1 OF 21 1 2 3 4 5 6 7 8 9 10 11 12 i of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. Section 3. Repeater. All ordinances and resolutions inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. Section 4. Emergency. It is essential to the public health, safety and welfare that appropriate water service be provided to the Governor and his family, and for the official functions that will occur at the Governor's mansion in Little Rock, since the current renovation of the mansion may impact the facilities that provide water to the mansion, and since it is necessary to be assured that there is no such disruption of service, an emergency is declared to exist and this ordinance shall be in full force and effect from and after the date of its passage.
