AN ORDINANCE APPROVING MODIFICATION TO A
PLANNED ZONING DISTRICT AND PROVIDING FOR
THE ESTABLISHMENT OF A PLANNED ZONING
DEVELOPMENT TITLED JACOBS - REVISED PCD
(Z- 6698 -A) , LOCATED WITHIN THE 3800/3900
BLOCK OF JOHN BARROW ROAD (WEST SIDE) , IN
THE CITY OF LITTLE ROCK, AKRANSAS,
AMENDING ORDINANCE NO. 18,078 AND CHAPTER
36 OF THE CODE OF ORDINANCES OF THE CITY
OF LITTLE ROCK; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS.
SECTION 1. That Ordinance No. 18,078 passed on
August 3, 1999, be amended to provide for modification of
the Planned Zoning Development described as Jacobs -
Revised PCD (Z- 6698 -A);
SECTION 2. That the zone classification of the
following described property be changed from PCD to Revised
PCD:
PARCEL 1: Lots 3, 4, 5 and 6, Block 165, John
Barrow Addition to the City of Little Rock,
Pulaski County, Arkansas and the North ',� of that
portion of West 39th Street between Barrow Road
and Ludwig Street, abutting Block 165 and 166 of
John Barrow Addition to the City of Little Rock,
Arkansas, vacated and closed by Ordinance Number
16,176 recorded February 18, 1992 as Instrument
Number 92- 11863.
Less and Except a tract of land situated in Lots
3, 4, 5, and 6, Block 165, John Barrow Addition
to the City of Little Rock, Pulaski County,
Arkansas, being more particularly bound and
described as follows: Beginning at the SE
corner of said Lot 3; thence N88 029158" West,
along the South line of said Lot, 8.69 feet;
thence along the proposed West right -of -way line
of John Barrow Road the following courses and
distances: 1401 027102" East, 73.46 feet;
N01 040115" East, 50.0 feet; N07 °26119" East,
69.65 feet; thence S87 048127" East, along the
North line of said Lot 6, said North lot line
also bei'Pthe South right -of -way 110 of West
39th Street, 5.78 feet; thence S01 °41153" West,
along the existing West right -of -way line of
John Barrow Road, 192.58 feet to the point of
beginning.
PARCEL 2: Lots 1, 2, 3 and 4, Block 166, John
Barrow Addition to the City of Little Rock,
Pulaski County, Arkansas and the South 1� of that
portion of West 39th Street between Barrow Road
and Ludwig Street, abutting Blocks 165 and 166
of John Barrow Addition to the City of Little
Rock, Arkansas, vacated and closed by Ordinance
Number 16,176 recorded February 18, 1992 as
Instrument Number 92- 11863.
Less and Except a tract of land situated in Lots
1, 2, 3 and 4, Block 166, John Barrow Addition
to the City of Little Rock, Pulaski County,
Arkansas, being more particularly bound and
described as follows: Beginning at the SE
corner of said Lot 1; thence N87 °48124" West,
along the South line of said Lot, said South lot
line also being the North right -o£ -way line of
West 39th Street, 4.80 feet; thence along the
proposed West right -of -way line of John Barrow
Road N01 °52140" East, 140.71 feet and NO3 049152"
West 52.15 feet; thence S87 °48124" East, along
the North line of said Lot 4, 9.89 feet; thence
S01 °41153" West, along the existing right -of -way
line of John Barrow Road, 192.58 feet to the
point of beginning.
SECTION 3. That the revised site development plan be
approved as recommended by the Little Rock Planning
Commission.
SECTION 4. That the change in zoning classification
contemplated for Jacobs - Revised PCD is conditioned upon
obtaining final plan approval within the time specified by
Chapter 36, Article VII, Section 36- 454(d) of the Code of
Ordinances.
SECTION 5. That the map referred to in Chapter 36 of
the Code of Ordinances of the City of Little Rock,
Arkansas, and designated district map be and is hereby
amended to the extent and in the respects necessary to
affect and designate the change provided for in Section 2
hereof.
SECTION 6 . That this Ordinance shal0ot take effect
and be in full force until the final approval of the plan.
SECTION 7. Severability. In the event any title,
section, paragraph, item, sentence, clause, phrase, or word
of this ordinance is declared or adjudged to be invalid or
unconstitutional, such declaration or adjudication shall
not affect the remaining portions of the ordinance which
shall remain in full force and effect as if the portion so
declared or adjudged invalid or unconstitutional was not
originally a part of the ordinance.
SECTION 8.. Repealer. All laws, ordinances,
resolutions, or parts of the same, that are inconsistent
with the provisions of this resolution are hereby repealed
to the extent of such inconsistency.

BACKGROUND:
On August 3, 1999, the Board of Directors passed Ordinance No.
18,078, rezoning this property from R -3 to PCD. The approved
PCD allowed single building mixed office /commercial development.
The approved site plan included a 10,000 square foot building
(17 feet in height) located near the center of the site, with
parking on the north, south and east sides.
The following uses were approved for the building:
1. supplies Plus Co., Inc. (Office /showroom /warehouse) -
3,108 square feet (760 square feet of warehouse space)
2. Two (2) beauty salons - 1,936 square feet total
3. General office uses - 4,956 square feet
Alternate uses for the site are to be 0-3 permitted uses.

office zoning was also approved for the project. Approved hours
of operation will be from 8:00 a.m. to 5:00 p.m., Monday through
Saturday.
A. PROPOSAL /REQUEST:
The applicant proposes to revise the previously approved
PCD by adjusting the amount of building area, within the
approved building, to be devoted to the approved uses. The
property owner and owner of Supplies Plus Co., Inc., Edward
Jacobs, has determined that his office supply /office
furniture business will need to utilize more of the
building that was previously thought. The following is the
new proposed breakdown of use areas within the approved
building:
1. Supplies Plus Co., Inc. (Office /showroom /warehouse) -
6,000 square feet (3,600 square feet of
warehouse /storage space).
2. Two (2) beauty salons - 2,000 square feet
3. General Office uses - 2,000 square feet
The adjustment in the amount of building area to be devoted
to each of the approved uses is the only change proposed
for the previously approved PCD. There are no changes
proposed for the previously approved site plan.
B. EXISTING CONDITIONS:
To date, some site work has taken place on the property, as
the owner is preparing for construction of the building's
foundation. Single - family residences are located to the
north, south and west, with a church located to the
northwest along Ludwig Street. Single - family residences,
vacant R -3 zoned property and another church are located
across Barrow Road to the east.
C. NEIGHBORHOOD COMMENTS:
The John Barrow, Campus Place and Westwood Neighborhood
Associations have been notified of the public hearing. As
of this writing, staff has received one (1) phone call from
a person requesting information on this application.
D. ENGINEERING COMMENTS:

E. UTILITIES AND FIRE DEPARTMENT /COUNTY PLANNING:
No Comment.

F. ISSUES /TECHNICAL /DESIGN:
Planning Division:
This request is located in the Boyle Park Planning
District. The Land Use Plan shows Mixed Office and
Commercial for this property. The applicant has applied
for a revision of an existing Planned Commercial
Development to expand the office /warehouse within the
existing building. A land use plan amendment is not
required.
City Recognized Neighborhood Action Plan:
The applicant's property lies in the area covered by the
John Barrow Neighborhood Action Plan. The plan contains a
goal of enhancing the climate directed towards encouraging
new business and commercial establishments to locate in the
area as well as retention of existing businesses. This
plan does not list specific objectives or action statements
relative to this application.
Landscape Issues:
No Comments.
G. SUBDIVISION COMMITTEE COMMENT: (JUNE 21, 2001)
Edward Jacobs was present, representing the application.
Staff briefly described the revised PCD, noting that no
changes were proposed to the previously approved site plan.
The Committee briefly discussed the issue and forwarded the
application to the full Commission for resolution.
H. ANALYSIS:
As noted in paragraph A., the applicant proposes to revise
the previously approved PCD by adjusting the amount of
building area devoted to the approved uses. The net result
would be that Supplies Plus Co., Inc. (an office /supplies/
furniture business) would have additional overall building
area and approximately 2,840 additional square feet devoted
to warehouse /storage space. The applicant notes that there
will be no changes to the previously approved site plan.
Staff feels that the proposed changes to the previously
approved PCD are reasonable and will have no adverse impact

on the general area. The proposed adjustment of building
area devoted to the approved uses will cause no increase in
minimum required parking.
I. STAFF RECObMNDATIONS:
Staff recommends approval of the revised PCD as filed.
PLANNING COMMISSION ACTION: (JULY 12, 2001)
Staff presented a positive recommendation on this application,
as there were no further issues for resolution. There were no
objectors to this matter present.
The Chairman placed the item before the Commission for inclusion
within the Consent Agenda for approval as recommended by staff.
A motion to that effect was made. The motion passed by a vote
of 8 ayes, 0 nays and 3 absent.
