18521• i 1 ORDINANCE NO. 18,521 2 3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT FOR 4 COMPETITIVE BIDDING; TO APPROVE A CONTRACT WITH 5 MOTOROLA COMMUNICATIONS AND ELECTRONICS INC. TO 6 PURCHASE 87 PORTABLE RADIOS; TO DECLARE AN 7 EMERGENCY; AND FOR OTHER PURPOSES. 8 9 WHEREAS, the City police department has utilized a particular communications 10 system using Motorola products, and 11 WHEREAS, funds are available from the 2000 Local Law Enforcement Block 12 Grant to purchase 87 additional radios, and pursuant to federal regulations, the process 13 has been followed which would justify a finding that it is impractical and unfeasible to 14 bid for the purchase of these additional radios, and 15 WHEREAS, this equipment is essential to assure that the mission of the Little 16 Rock Police Department to protect citizens and property is fulfilled, 17 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS is OF THE CITY OF LITTLE ROCK, ARKANSAS: 19 Section 1. The City Manager is authorized to enter into an agreement with 20 Motorola Communications and Electronics, Inc., for the purchase of 87 portable radios 21 (XTS 3000 Model II) for a cost not to exceed two hundred and eighty eight thousand one 22 hundred and ninety-one dollars ($288,191.00), plus any applicable sales or 23 compensating use tax that may be applied to this purchase. 24 Section 2. Funds for this purchase are available from the 2000 Local Law 25 Enforcement Block Grant as maintained in Account No. 210 - 350 -A535- 7050). 26 Section 3. Since the block grant monies can be expended in accordance with 27 local purchasing standards and local purchasing laws, the Board finds the following [PAGE 1 OF 31 • • 1 factors make it impractical and unfeasible to submit this particular purchase to a 2 competitive bid: 3 (a) These 87 additional radios are necessary to help assure that each sworn 4 City police officer is equipped with such a radio; 5 (b) The architecture for the City's emergency communication system is 6 already in place, and these radios are virtually the only ones that are compatible with 7 the City's 800 mHz radio system; and 8 (c) An appropriate finding was made by the advisory board on block grants 9 which recommended this approach, and a public hearing which detailed the spending to plan for the purchase of these radios did not result in any opposition. 11 Section 4. Severability. In the event any title, section, paragraph, item, 12 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid 13 or unconstitutional, such declaration or adjudication shall not affect the remaining 14 portions of the ordinance which shall remain in full force and effect as if the portion so 15 declared or adjudged to be invalid or unconstitutional was not originally a part of the 16 ordinance. 17 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same 18 that are inconsistent with the provisions of this ordinance are hereby repealed to the 19 extent of such inconsistency. 20 Section 6. Emergency Clause.
