18469C I ORDINANCE NO. 18.469 E 2 3 AN ORDINANCE TO DISPENSE WITH COMPETITIVE BIDDING 4 AND TO AUTHORIZE THE CITY MANAGER TO ENTER INTO A 5 CONTRACT WITH BALLET ARKANSAS; TO DECLARE AN 6 EMERGENCY; AND FOR OTHER PURPOSES. 7 8 WHEREAS, Ballet Arkansas provides unique cultural and educational programs for 9 citizens of the City, as well as for people located throughout central Arkansas, and many of 10 these programs enhance the educational experience for Little Rock youth and can provide a 11 means to teach students of dance, and other disciplines, unique methods to train for the 12 rigors of ballet dance and other types of expressive dance, and 13 WHEREAS, after careful negotiation the City has discovered that it can contract 14 with Ballet Arkansas to provide certain unique services to its citizens, and to express its 15 support of such cultural programs as an aspect of overall educational, as well as prevention, 16 intervention and treatment programs, and 17 WHEREAS, the support and presentation of ballet within the City, and the support 18 of a special school for ballet artists, is a unique function of Ballet Arkansas which makes it 19 impractical and unfeasible to issue a formal competitive bid for these contractual services, 20 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 21 OF THE CITY OF LITTLE ROCK, ARKANSAS: 22 Section 1. The City Manager is authorized to enter into a contractual agreement, 23 the legal form of which is approved by the City Attorney, with Ballet Arkansas for an 24 amount not to exceed forty thousand dollars ($40,000) to provide specified educational and 25 cultural services to the City as a part of its overall educational and prevention, intervention 26 and treatment programs, and to purchase certain advertising space on Ballet Arkansas 27 programs. 28 Section 2. Funds for this contract are available from carryover funds for 29 Prevention, intervention and Treatment (PIT). 30 Section 3. Because of the unique services provided by Ballet Arkansas to the 31 central Arkansas area, including but not limited to the joint operation of a school of dance [PAGE 1 OF 21 0 0 1 which will assist the City to produce a videotaped presentation in cooperation with its 2 Department of Parks & Recreation on the types of exercises ballet students, as well as 3 students of other forms of expressive dance, need to undertake, it is impractical and 4 unfeasible to submit this contract to a formal competitive bidding process. 5 Section 4. Severability. In the event any title, section, paragraph, item, sentence, 6 clause, phrase, or word of this ordinance is declared or adjudged to be invalid or 7 unconstitutional, such declaration or adjudication shall not affect the remaining portions of 8 the ordinance which shall remain in full force and effect as if the portion so declared or 9 adjudged to be invalid or unconstitutional was not originally a part of the ordinance. 10 Section 5. Repealer. All ordinances and resolutions, including by not limited to 11 Little Rock, Ark., Ordinance No. 18,409 (December 26, 2000) ( "the 2001 Budget 12 ordinance'), is hereby repealed to the extent of such inconsistency. 13 Section 6. Em nem y. The ability to plan and produce the various videotaped 14 presentations contemplated by the contract approved in this ordinance, and to assure that all 15 deadlines are met for advertising space the City wishes to purchase to show its support and 16 involvement in these cooperative efforts with Ballet Arkansas, particularly since these 17 programs are a part of the City's education, as well as prevention, intervention, and 18 treatment programs, is essential to the public health, safety and welfare; an emergency is, 19 therefore, declared to exist and this ordinance shall be in full force and effect from and after 20 the date of its passage. 21 PASSED: April 17 , 2001 22 ATTEST: APPROVED: 23 24 25 NtTot it y Clerk J' alley, Mayor 26 APPROVED AS TO LEGAL FORM: 27 29 Thomas M.
