184490 0 1 ORDINANCE NO. 18,_449 _ 2 3 AN ORDINANCE TO DECLARE ENVIRONMENTAL SYSTEMS 4 ENGINEERS & SUPPLIERS A PROFESSIONAL SERVICE; TO 5 AMEND LITTLE ROCK, ARK., REV. CODE § 2 -243 (a) (2) (1988) 6 TO INCLUDE THIS DEFINITION; AND FOR OTHER PURPOSES. 7 8 WHEREAS, the City Manager has directed that a review be 9 made of the City's energy costs and, to determine if there is a 10 methodology that can be used to decrease these costs, and 11 WHEREAS, after initial reviews of the City's needs and uses, 12 it has been determined that the City could best be served by the 13 employment of an environmental consultant, and 14 WHEREAS, the aspect of such work that qualifies as 15 engineering services is already a professional service that can be 16 selected upon the basis of the entity that is most qualified to perform 17 the work, but the aspect of the work that also permits the City to 18 purchase from this consultant that actual materials and equipment 19 needed to implement a particular environmental program is not 20 included within such a definition, and 21 WHEREAS, after review with various companies, the City has 22 learned that the best cost savings can be gained with a competitive 23 selection process to choose the environmental consultant and, at the 24 same time, to permit the City to purchase the materials from the 25 consultant needed to implement the system designed by the 26 environmental engineer, and 27 WHEREAS, the basis for the selection of the environmental 28 consultant who designs this program is the most qualified, and a part 29 of the qualifications determination is the quality of the materials the 30 consultant recommends to meet the overall needs of the City, 1 I NOSY, THEREFORE, BE IT ORDAINED BY THE BOARD 2 OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: 3 Section 1. Little Rock, Ark., Rev. Code § 2 -243 (a) (2) (1988), 4 is hereby amended to add "Environmental Systems Engineers & 5 Suppliers," as a professional service. 6 Section 2. Severability. In the event any title, section, 7 paragraph, item, sentence, clause, phrase, or word of this ordinance 8 is declared or adjudged to be invalid or unconstitutional, such 9 declaration or adjudication shall not affect the remaining portions of 10 the ordinance which shall remain in full force and effect as if the 11 portion so declared or adjudged to be invalid or unconstitutional was 12 not originally a part of the ordinance. 13 Section 3.
