184360 ORDINANCE No. 18,436 AN ORDINANCE RECLASSIFYING PROPERTY LOCATED IN THE CITY OF LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS, SECTION 1. That the zone classification of the following property be and is hereby changed as indicated: Z- 6888 -A - TRACT 1 - described as the South '1!, North ''L, NE 4, SW ;i, Section 11, T -1 -N, R -13 -W, City of Little Rock, Pulaski County, Arkansas, LESS and EXCEPT the right -of -way for John Barrow Road: From 110-3" General Office and "OS" Open Space District to 110-3" General Office District and; TRACT 2 - The North =s, North 't, NE 4, SW 4, Section 11, T -1 -N, R -13 -W, City of Little Rock, Pulaski County, Arkansas, LESS and EXCEPT the right -of -way for John Barrow Road: From "R -4" Two - Family Residential and 110-1" Quiet Office to 110-3" General Office District; LESS and EXCEPT the following described portion of the properties described as Tracts 1 and 2 above which is hereby zoned "C -3" General Commercial District: Part of the HE 4 SW '4, Section 11, T -1 -N, R -13 -W, City of Little Rock, Pulaski County, Arkansas, being more particular described as follows: Commencing at the center of said Section 11, T -1- N, R -13 -W; thence N89 °42100" West, 1,084.05 feet to the point of beginning; thence South, 399.77 feet to a point on a 500 foot radius curve to the left, said curve having a chord bearing and distance of N81 °46'03" East, 126.47 feet; thence N74 °19'19" East, 187.77 feet; thence South, 280.20 feet; thence N89 047100" West 536.00 feet; 0 0 thence North, 329.00 feet; thence N00 °17100" West 331.00 feet; thence S89 °42100" East, 231.95 feet to the point of beginning. Containing 225,272.27 square feet or 5.17 acres, more or less; And LESS and EXCEPT the following described portion of the properties described as Tracts 1 and 2 above which is hereby zoned "OS" Open Space District: A 50 -foot wide strip located parallel to and along the eastern perimeter of the property and a 50 -foot wide strip located parallel to and along the northern perimeter of the property for a distance of 1,084.05 feet west of the northeast corner of the property. (All located at 1911- 2109 John Barrow Road) SECTION 2. That the zoning of the C -3 zoned portion of the property described in Section 1 of this ordinance shall be subject to the following condition which was proposed by the applicant and which shall be a covenant running with the land to bind subsequent grantees of the property: o The following list of uses shall comprise in total the only list of uses permitted on the property: • Bank or savings and loan office • Book and stationary store • Clinic (medical, dental or optical) • Clothing Store (medical related) • Community welfare or health center • Drugstore or pharmacy • Eating place, without drive -in service • Establishment of a religious, charitable or philanthropic organization • Laboratory • Office (general and professional) • Optical shop SECTION 3. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Sections 1 and 2 hereof. 2 ! • SECTION 4. That the Ordinance shall take effect and be in full force 30 days after the date of its passage and approval. SECTION S. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared to adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 6. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this resolution are hereby repealed to the extent of such inconsistency.
