3 AN ORDINANCE TO AUTHORIZE A CONTRACT WITH THE URBAN
4 LAND INSTITUTE ADVISORY SERVICES TO STUDY THE AREA
5 SURROUNDING MARKHAM STREET AND UNIVERSITY AVENUE;
6 TO DISPENSE WITH FORMAL COMPETITIVE BIDDING; AND FOR
7 OTHER PURPOSES.

9 WHEREAS, recent zoning cases have presented to the Board of Directors issues such
to an infill in the Hillcrest Area, and about a proposed shopping mall in west Little Rock which
11 might attract anchor tenants at the University Mall and the Park Plaza Mall, and have raised
12 serious questions about development in the area surroudning Markham Street and University
13 Avenue, and
14 WHEREAS, one aspect of this concern expressed before the Little Rock Planning
15 Commission was what would be the impact upon the quality of life in the area if either the
16 University Mall or the Park Plaza Mall ceased to operate, or had substantially diminished
17 operations, and
18 WHEREAS, a second concern was what additional study and information needs to be
19 considered to assure that infill development in this area is appropriate for the area and
20 compatible with the neighborhoods, and
21 WHEREAS, the applicant for the west Little Rock mall site agreed to pay a portion fo
22 the cost for such a study, and
23 WHEREAS, after careful review and consideration it was determined that either the
24 Urban Land Institute, the American Institute of Architects, or the American Planning
25 Association, could provide an advisory service with the expertise to address these issues, and
26 WHEREAS, in light of the pending zoning requests and other matters, including the
27 payment from the developer, it is not practical or feasible to submit this matter to strict
28 competitive bidding, but time has been taken to discuss the various issues with these entities
29 and to determine which approach is the most compatible with the City's needs and, assures the
30 experience and expertise to develop a realistic plan of implementation once the study is
31 complete,

1 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
2 THE CITY OF LITTLE ROCK, ARKANSAS:
3 Section 1. The City Manager is authorized to enter into an agreement for an amount
4 not to exceed one hundred and ten thousand {$110,000.00} of City money with the Urban Land
s Institute Advisory Service to study the area that surrounds Markham Street and University
6 Avenue, develop a realistic plan for the development of this area that includes, among other
7 things, a proposed implementation plan.
8 Section 2. Funds for this agreement are available from the General Fund Contingency
9 Account, and will also be provided by developers in the area.
10 Section 3. Because of the pending request for the development of a west Little Rock
11 mall site that could impact the Park Plaza Mall and the University Mall, and which certainly
12 make concerns about the continued viability of the malls and what could happen to this area
13 should either or both of them cease to operate, it is not practical nor feasible to submit this
14 selection process to formal competitive bidding, so to the extent that more is required than
1s contact with the entities notified,
16 Section 4. Severability. In the event any title, section, paragraph, item, sentence,
17 clause, phrase, or word of this ordinance is declared or adjudged to be invalid or
18 unconstitutional, such declaration or adjudication shall not affect the remaining portions of the
19 ordinance which shall remain in full force and effect as if the portion so declared or adjudged
20 invalid or unconstitutional was not originally a part of the ordinance.
21 Section S. Repealer. All laws, ordinances, resolutions, or parts of the same, that are
22 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such
23 inconsistency.
24 Section 6. Emergency. The ability to make proper plans for the use ofproperties in the area of
25 Markham and University is essential to the public health, safety and welfare, in order to assure that
26 appropriate planning and the quality of life within this particular neighborhood is properly maintained;
27 an emergency is, therefore, declared to exist and this ordinance shall be in full force and effect from and after
28 the date of its passage.
