18408r] 0 I ORDINANCE NO.. 18,4 8 2 3 AN ORDINANCE TO REPEAL SECTIONS OF THE SIGN 4 REGULATIONS OF THE LITTLE ROCK ZONING CODE WHICH 5 PERTAIN TO THE EXCHANGE OF BILLBOARD SITES; TO 6 AUTHORIZE THE USE OF THE PROCEEDS OF CERTAIN FEES, 7 COLLECTED FOR THE INSPECTION OF BILLBOARDS, TO BE 8 USED FOR LANDSCAPING AND OTHER PURPOSES; TO 9 DECLARE AN EMERGENCY) AND FOR OTHER PURPOSES. 10 11 WHEREAS, the City has previously permitted the voluntary removal of a 12 billboard to lead to the location of two billboards in other parts of the City, and 13 WHEREAS, this practice is no longer deemed appropriate or consistent with the 14 City's interest in landscaping and aesthetic value, and 15 WHEREAS, the recent landscaping and tree preservation ordinances, to be 16 effective, must be properly funded, and the Board of Directors believes that some of the 17 billboard permit fees that have been escrowed for various purposes, including landscape 18 efforts, can be an appropriate use of these monies, and 19 WHEREAS, Little Rock, Ark., Resolution No. 10,903 (September 26, 2000) sets 20 forth an urban forestry initiative to be followed and implemented by the City, 21 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF 22 DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: 23 Section 1. Little Rock, Ark., Rev. Code § 36- 556(g) (1988) is hereby repealed. 24 Section 2. Little Rock, Ark., Rev. Code § 36 -556 (1988) is hereby amended to 25 add the following new subsection: 26 (g) Funds on deposit in the billboard account, if used for 27 landscaping purposes, shall first be used by the City for the 28 placement of trees within a 250 -foot radius of existing [1] I billboard sites in the City. After such landscaping and tree 2 placement in areas near billboard sites has been 3 accomplished in any given budget year pursuant to an 4 appropriately created plan, any funds in this account may 5 then be used by the City as part of the urban forestry 6 initiative. 7 Section 3. Severability. In the event any title, section, paragraph, item, sentence, s clause, phrase, or word of this ordinance is declared or adjudged to be invalid or 9 unconstitutional, such declaration or adjudication shall not affect the remaining portions 10 of the ordinance which shall remain in full force and effect as if the portion so declared 11 or adjudged invalid or unconstitutional was not originally a part of the ordinance. 12 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that 13 are inconsistent with the provisions of this resolution are hereby repealed to the extent 14 of such inconsistency. is Section 5. Emergency.
