183471 ORDINANCE NO. 18,347 y 2 AN ORDINANCE TO AWARD A CONTRACT TO CRUSE 3 UNIFORMS TO PROVIDE FIRE CLOTHING FOR THE BALANCE 4 OF THE CONTRACT YEAR; TO DECLARE AN EMERGENCY; 5 AND, FOR OTHER PURPOSES. 6 WHEREAS, after a competitive bid process, the City awarded a one -year contract to 7 Command Uniforms in 1998, which with proper extensions could be valid until December 31, 8 2000, to provide clothing to the Little Rock Fire Department, pursuant to Little Rock, Ark., 9 Resolution No. 10,180 (January 20, 1998), and 10 WHEREAS, subsequent to the award of the contract, Command Uniforms went out of 11 business, and the City intended to enter into an agreement with R & R Uniforms (now doing 12 business as "Skagg "), the second lowest responsible and responsive bidder, to provide such 13 clothing for the balance of the agreement, but it became apparent that Skagg could not timely 14 fulfill the obligations of the contract with the City, and 15 WHEREAS, the ability to meet these demands is essential to the efficient running of 16 the department, and to the protection of the public health, safety and welfare, and 17 WHEREAS, the items provided through this agreement are dependent, in part, upon 18 the negotiated agreement with Local 34 of the International Association of Fire Fighters, and 19 beginning in the year 2001, the items will be different from those currently authorized, and 20 WHEREAS, before a new contract is entered through a competitive bid process for fiscal 21 year 2001, it is important to provide a vendor for this agreement, but there is not sufficient time 22 to subject this bid to a published competitive process under all of these circumstances, and 23 NOW, THEREFORE, BE TT ORDAINED BY THE BOARD OF DIRECTORS OF 24 THE CITY OF LITTLE ROCK, ARKANSAS: 25 Section 1. The City Manager is authorized to enter into an agreement with Cruse 26 Uniforms to provide uniform items and other clothing pursuant to the negotiated agreement 27 between the City and the firefighters until a new contract can be entered through a competitive 28 bidding process. 29 Section 2. The fact the original award of this contract had to be redirected when the 30 successful bidder went out of business, and the second bidder was not able to fulfill the terms 111 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 of the agreement in a timely fashion, and the fact that this agreement will be for a short period of time until a new multi -year agreement can be recommended after a competitive bidding process, makes it impractical and unfeasible to subject this short time contract to competitive bidding. Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this resolution are hereby repealed to the extent of such inconsistency. Section 5. Emergency. The ability to provide proper uniform clothing and other such items as needed to City firefighters is essential to protect the public health, safety and welfare, but this ability is currently hampered because the prior suppliers of these items have either gone out of business, or have not been able to comply with the terms of the agreement for other reasons. An emergency is, therefore, declared to exist and this ordinance shall be in full force and effect from and after the date of its passage.
