18273• 1 ORDINANCE NO. 18,273 + 53 2 3 AN ORDINANCE TO AUTHORIZE A NEW CONTRACT 4 FOR THE SUPPLY OF POLICE UNIFORMS; TO 5 DISPENSE WITH COMPETITIVE BIDDING; TO 6 DECLARE AN EMERGENCY; AND FOR OTHER 7 PURPOSES. 8 9 WHEREAS, the City previously issued bids for clothing and equipment for the police 10 department, and the successful bidder was Skaggs Public Safety, and 11 WHEREAS, since June, 1999, the City has experienced difficulties with the main 12 vendor actually delivering equipment and clothing as needed, and 13 WHEREAS, in February, 2000, the police department was informed that it would be 14 difficult for Skaggs Public Safety to get new products and that any purchases would have to be 15 filled from existing inventory, and that after receiving this information it was learned that 16 various suppliers had placed Skaggs Public Safety on a credit hold status, and 17 WHEREAS, other law enforcement departments in the area have canceled their 18 contracts with Skaggs Public Safety, and 19 WHEREAS, there is insufficient time to prepare, advertise, and receive proposals on a 20 uniform and equipment bid before the new recruit class starts, and it is necessary to obtain 21 several thousands of dollars of items currently on back order, and 22 WHEREAS, the department has learned that Cruse Uniforms and Equipment is 23 available to provide immediate service to the department, and is willing to do so until the City 24 can prepare an appropriate bid procedure, 25 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 26 THE CITY OF LITTLE ROCK, ARKANSAS: 27 Section 1. The City Manager is authorized to formally terminate the agreement 28 between the City and Skaggs Public Safety to provide uniforms and equipment to the police 29 department, and is authorized to enter, on an emergency basis, a contract with Cruse Uniforms 30 and Supply to provide such equipment. 0 0 53 1 Section 2. This contract with Cruse Uniforms and Equipment can be used to provide 2 equipment for the scheduled recruit class, to provide any items to the police department that are 3 currently on back order with Skaggs Public Safety, and to provide any additional equipment 4 properly ordered, between the date of this ordinance and the date that a new vendor can be 5 selected after an appropriate competitive bidding process. 6 Section 3. Because of the great need for items currently on back order, equipment 7 for a scheduled recruit class, and a supplier of police uniforms and equipment until another 8 supplier can be selected, and because there is insufficient time to prepare bids and select a new 9 supplier bidder for these services and still meet these needs, the Board of Directors finds that 10 it is impractical and unfeasible to bid and, therefore, dispenses with the requirement of 11 competitive bidding for purposes of this ordinance. 12 Section 4. Severability. In the event any section, subsection, subdivision, 13 paragraph, subparagraph, item, sentence, clause, phrase, or word of this ordinance is declared 14 or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect 15 the remaining portions of the ordinance which shall remain in full force and effect as if the 16 portion so declared or adjudged invalid or unconstitutional was not originally a part of the 17 ordinance. 18 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same, that 19 are inconsistent with the provisions of this resolution are hereby repealed to the extent of such 20 inconsistency. 21 Section 6. Emergency Clause.
