WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas on the 14th day of January , 2000, asking the Board of Directors to vacate a public utility easement designated on the plat of Markham Commercial Subdivision, an Addition to the City of Little Rock, Arkansas, now appearing of record in Plat Book C, Page 008, in the office of the Recorder of Pulaski County, Arkansas. WHEREAS, after due notice as required by law, the Board has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the easement hereinbefore described, has heretofore been dedicated to the public use as a utility easement herein described; has been used by the public generally for a period of approximately thirteen (13) years subsequent to the filing of the plat; that all the owners of the property abutting upon the portion of the utility easement to be vacated have filed with the Board their written consent to this action; and that public interest and welfare will not be adversely affected by the vacating of the utility easement. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the utility easement designated as follows: Easement Abandonment Description Part of Lots, 7, 8 and 9, Markham Commercial Subdivision, City of Little Rock, Pulaski County, Arkansas more particularly described as follows: Commencing at the SW Corner of said Lot 7; thence N 38° 39' 51" E, along the West line of said Lot 7, 15.41 feet for the POINT OF BEGINNING; thence N 66° 33'49" W, 10.36 feet; thence N 380 39' 51" E, 217.61 feet; thence S 510 07'41" E, 20.00 feet; thence S 380 39' 51" W, 212.09 feet; thence N 660 33'49" W, 10.36 feet to the West line of said Lot 7 to the POINT OF BEGINNING, containing 0.099 Acres (4,297 sq. ft.) more or less. SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the Office of the Recorder of Pulaski County and recorded in the records of the County. SECTION 3. This Ordinance shall take effect and be in force from and after its passage an approval.
