3 AN ORDINANCE TO AUTHORIZE THE CITY
4 MANAGER TO ENTER INTO AN AGREEMENT
5 WITH J.A. RIGGS FOR REPAIRS TO THE LANDFILL
6 CATERPILLAR COMPACTOR; TO WAIVE
7 COMPETITIVE BIDDING; TO DECLARE AN
s EMERGENCY; AND FOR OTHER PURPOSES.

10 WHEREAS, the Public Works Department, after competitive bidding, purchased
11 a compactor for the landfill, and
12 WHEREAS, this compactor has developed certain mechanical problems that
13 need to be repaired immediately for an estimated cost of $19,177.50, and
14 WHEREAS, the need to complete this repair immediately by an authorized
15 dealer makes it impractical and unfeasible to submit the cost of these repairs to a
16 competitive bid process,
17 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
18 DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
19 Section 1. The City Manager is authorized to enter into an agreement with J.
20 A. Riggs of Little Rock, Arkansas, a Caterpillar contracting firm, in an amount
21 estimated to be $19,177.50, for the repair of the transmission housing for a Caterpillar
22 trash compactor.
23 Section 2. The need for immediate repairs because this particular item is used
24 at the City landfill, and the limited number of companies capable of doing this work in
25 the local area, make it impractical and unfeasible to bid, therefore the requirement for
26 competitive bidding is waived.
27 Section 3. Emergency. The need to have working compactors at the City
28 landfill on a daily basis is essential to the protection of the public health, safety and
29 welfare, and the ability to comply with state and federal laws that regulate the disposal

of solid waste; because it is important to repair this compactor immediately, and to
waive competitive bidding so immediate repair can occur, an emergency is declared to
exist and this ordinance shall be in full force and effect from and after the date of its
passage.
