9 WHEREAS, it has been determined that the remaining portions of right -of -way
CN10 of Candlewood Drive, a street within the City of Little Rock, Arkansas, are no longer
11 needed for corporate purposes except for public utility, drainage, and access purposes,
d 12 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
013 DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
414 Section 1. Pursuant to its authority under Ark. Code Ann. § 14- 54-104 (Michie

15 Repl. 1998), the City of Little Rock, Arkansas, hereby releases, vacates and abandons

16 all of its rights together with the rights of the public, in and to the remaining portions of
17 the right -of -way of Candlewood Drive, a street within the City of Little Rock, Arkansas,
-4 18 said right -of -way being described as follows:
19 All right -of -way of Candlewood Drive lying in the SE' /4 SE 1/4; and the
d 20 South 10.0 feet of the NE' /4 SE Y4; Section 18, Township 2 -North, Range
w
21 13 -West, Pulaski County, Arkansas, shown on that certain plat recorded
22 in Plat Book 18, Page 6, in the Office of the Circuit Clerk of Pulaski
23 County, Arkansas,
24 provided that this vacation and abandonment is subject to a reservation by the City of
25 public utility, drainage, and access easements pursuant to terms acceptable to the City,
26 and providing further that if such easements are not executed and filed of record with
27 the Pulaski County Clerk by February 15, 2000, the vacation and abandonment of this
28 street shall not occur.

Section 2. Abutting owners of record receiving title to the vacated and 35
abandoned right -of -way shall at their cost remove all vestiges of public use as necessary.
Section 3. A copy of this Ordinance, duly certified by the City Clerk, shall be
filed in the Office of the Recorder of Pulaski County, Arkansas, and recorded in the
records of said County.
Section 4. This abandonment and street closure shall take effect, if at all, upon
the passage of this Ordinance and the acceptance and filing of the public easements
reserved in Section 1.
