s AN ORDINANCE TO WAIVE COMPETITIVE
4 BIDDING; TO AUTHORIZE THE MANAGER TO
s ENTER INTO AN AGREEMENT WITH AMERICAN
6 MANAGEMENT SYSTEMS, INC. (AMS) IN THE
7 AMOUNT OF $105,161 FOR COMPUTER SOFTWARE
8 MAINTENANCE FOR THE CITY'S FINANCE
9 SYSTEM FOR A PERIOD OF ONE YEAR; AND FOR
10 OTHER PURPOSES.

12 WHEREAS, in 1987, after a competitive process, the City purchased a finance
13 software package from AMS, and has been operating under a maintenance agreement
14 since that time, and
1s WHEREAS, since AMS developed the software which has now been licensed to
16 the City, to competitively bid the maintenance agreement would either be extremely
17 costly since any new company would have to learn the basics of the system that AMS
18 already knows, or a new company would not want to bid on the package since it did not
19 create the software, and
20 WHEREAS, these facts make it impractical and unfeasible to bid this
21 maintenance contract,
22 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
23 DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
24 Section 1. The Board of Directors finds that it is impractical and unfeasible to
25 bid the maintenance contract for the City's financial computer software and, therefore,
26 waives the requirement for competitive bidding.
27 Section 2. The City Manager is authorized to enter into a contractual
28 agreement with AMS in the amount of $105,161 to provide maintenance for the City's

financial computer software package; further, the City Manager is authorized to extend
this agreement by two additional one year increments if he believes that such extension
is in the best interests of the City. 8415
