ro 10 WHEREAS, the Board recently considered a proposal to establish new

11 regulations and a new permitting procedure for horse drawn vehicles upon the streets
y 12 within the City of Little Rock, and

a 13 WHEREAS, the City is granted authority to regulate carriages for hire pursuant
0' 14 to Ark. Code Ann. § 14 -54 -1403 (Michie 1998), as may be amended, and

15 WHEREAS, during public discussion of the proposed ordinance there were
t7 16 several concerns raised about the welfare of animals being used to pull carriages on

017 public streets including, but not limited to, testimony about the impact of this activity
cn 18 on a horse's legs, and the impact upon the animal's respiratory system, and
19 WHEREAS, upon consideration of these factors, and others, the Board
20 concluded that not only should it not adopt a new ordinance, but it should prchibit the
21 use of horse drawn vehicles, or vehicles pulled by any other animal, on the streets within
22 the City of Little Rock,
23 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
24 DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
25 Section 1. Little Rock, Ark., Ordinance 15,488 (June 21, 1988), is hereby
26 repealed.
27 Section 2. It shall be unlawful to operate or cause to be operated upon the
28 streets within the City any vehicle, or whatever nature, drawn by any animal. Nothing
(Rm. 1- 3-00.)
I in this ordinance shall be deemed to prevent any animal from being used to pull a
2 wagon, carriage, dray, or other vehicle, as a part of a properly permitted parade. 800-
3 Section 3. Violation of this Ordinance shall be punished in accordance with the
4 provisions of Little Rock, Ark., Rev. Code § 1 -9 (1988).
5 Section 4. Severability. In the event any title, subtitle, section, subsection,
6 subdivision, paragraph, subparagraph, item, sentence, clause, phrase, or word of this
7 ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
8 adjudication shall not affect the remaining portions of the ordinance which shall remain
9 in full force and effect as if the portion so declared or adjudged invalid or
10 unconstitutional was not originally a part of the ordinance.
