3 AN ORDINANCE WAIVING COMPETITIVE BIDDING AND
4 AUTHORIZING THE CITY MANAGER TO ENTER INTO A
5 GOLF COURSE CONSTRUCTION CONTRACT WITH
6 LANDSCAPES UNLIMITED IN THE AMOUNT OF $646,800
7 FOR THE DEVELOPMENT OF PHASE I IMPROVEMENTS
8 AT FIRST TEE.

10 WHEREAS, the Board of Directors may dispense with the requirement of
11 competitive bidding in exceptional situations where such procedure is impractical
12 and unfeasible; and
13 WHEREAS, staff has established a verbal partnership with the First Tee which is
14 an initiative to create new golf facilities and access with a special emphasis on kids who
15 otherwise may not have an opportunity to experience the game; and
16 WHEREAS, the old Rock Creek Golf Course behind Asher and University Avenue
17 has been chosen for site development; and
18 WHEREAS, a master plan was prepared for a minimal fee that reflects nine
19 regulation golf holes, nine chip and putt holes, putting course, practice green, practice
20 range, club house, maintenance building and parking (over $3,000,000 value); and
21 WHEREAS, Landscapes Unlimited was identified as the contractor willing to
22 discount their services; and
23 WHEREAS, due to limited funds the project was reduced to nine regulation holes,
24 practice range and practice green for $646,800; and
25 WHEREAS, while Landscapes Unlimited is willing to do this project at cost because
26 of its involvement with the First Tee Program, but other companies contacted cannot
27 possible meet this price, the Board of Directors finds it to be impracticable and unfeasible
28 to submit this program for formal competitive bidding; and

WHEREAS, it is in the best interests of the City Parks program to accept this cost
price from Landscapes Unlimited in order to fully utilize the donation of the First Tee
Program of $500,000.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 9. The Board of Directors hereby finds that competitive bidding for
golf course construction shall be dispensed with as impracticable and unfeasible..
SECTION 2. The City Manager is authorized to waive competitive bidding and
enter into a golf course construction contract with Landscapes Unlimited in the
amount of $646,800 for the development of Phase I Improvements at First Tee.
SECTION 3. Funding is available from account number 305- 230 -0968, a
grant and donations.
