AN ORDINANCE VACATING AND CLOSING A PORTION OF
o RIVERCREST DRIVE /CANDLEWOOD DRIVE IN
CANDLEWOOD SUBDIVISION OF THE CITY OF LITTLE

WHEREAS, a petition was duly filed with the Board of Directors of the City of
9 Little Rock, Arkansas on the 27 day of September, 1999, asking the Little Rock Board
of Directors to vacate and abandon all that portion of Rivercrest Drive /Candlewood Drive
co between Candlewood Subdivision Phase II and 1300 feet north of Cantrell Road in
0 Candlewood Subdivision of the City of Little Rock, Arkansas, as designated on the plat
of said Addition now appearing of record in Plat Book 18, Page 6, in the office of the
Recorder of Pulaski County, Arkansas; and
ON
WHEREAS, after due notice as required by law, the Board of Directors has, at
� the time and place mentioned in the notice, heard all persons desiring to be heard on the
question; has ascertained that the street hereinbefore described has been dedicated to the
public use as a street; has not been actually used by the public generally for a period of at
d least five (5) years subsequent to the filing of the plat; that all owners of the property
dabutting upon that portion of the street to be vacated have filed with the City Clerk their
d written consent to the abandonment; and

M WHEREAS, the public interest and welfare will not be adversely affected by the

abandonment of the street.

x NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
.. DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and
abandons all its rights, together with the rights of the public generally, in and to the street
designated as follows:
Rivercrest Drive/Candlewood Drive between Candlewood Subdivision
Phase II and 1300 feet north of Cantrell Road, more particularly
described on the attached Exhibit A.
SECTION 2. This closure is conditioned upon the petitioner constructing to City
Code standards a public street extending from the current terminus of Candlewood Drive
to a point ten feet (10') north of petitioner's south property line and construction of a
public turnaround at that point. Furthermore, petitioner shall construct to City Code
standards a public turnaround at the current terminus of Rivercrest Drive at the north end
of petitioner's property.
SECTION 3. A copy of this Ordinance, duly certified by the City Clerk, shall be
filed in the Office of the Recorder of Pulaski County and recorded in the records of the
County.

SECTION 4. This Ordinance shall take effect and be in force from and after its
passage and approval.

the South 10.0 feet of the Northeast 1 /4, Southeast 1/4 of said Section -18.
