181000 0 1 ORDINANCE NO. 18,100 6 0 G 2 AN ORDINANCE TO AMEND LITTLE ROCK, CODE § 2- 3 243 (1988) TO DECLARE REAL ESTATE MARKETING A 4 PROFESSIONAL SERVICE; AND FOR OTHER 5 PURPOSES. 6 WHEREAS, the City has acquired a number of properties through purchase, gift, or lien 7 foreclosure, and 8 WHEREAS, it is sometimes appropriate for the City to market these properties, or even 9 to package these properties to be marketed, and to WHEREAS, it is also important to select a firm that has the expertise and background I1 to assure that the properties are marketed in a way that is consistent with other City interests 12 to preserve the aesthetics, history, or quality of life in a particular area, but that a selection 13 process which merely dealt with the lowest real estate commission might not meet these other 14 interests, and 15 WHEREAS, state law permits the City to declare that a particular service is a 16 professional service for which competitive selection can be based upon qualifications, and 17 WHEREAS, this ordinance was read in a similar form for the first time at a regular 18 meeting held September 7, 1999, 19 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 20 THE CITY OF LITTLE ROCK, ARKANSAS: 21 Section 1. Little Rock, Ark., Rev. Code § 2 -243 (a)(2) is hereby amended to add the 22 following: Real Estate Marketing. 23 Section 2. Severability. In the event any title, subtitle, section, subsection, 24 subdivision, paragraph, subparagraph, item, sentence, clause, phrase, or word of this ordinance 25 is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall 26 not affect the remaining portions of this ordinance which shall remain in full force and effect 27 as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of 28 this ordinance. 111 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 4l 28 0 0 G Section 3. Repealer. All ordinances, resolutions, or regulations, or any parts of such documents, which are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
