3 AN ORDINANCE TO ESTABLISH THE PHILANDER
4 SMITH TARGETED NEIGHBORHOOD
5 ENHANCEMENT PLAN (TNEP); AND FOR OTHER
6 PURPOSES.

8 WHEREAS, one of the goals of the Future - Little Rock process was to create a landbank
9 authority and to provide monies for lower to moderate income housing; and
10 WHEREAS, severe restrictions in the Arkansas Constifution prohibit municipalities from
11 engaging in programs that grant monies to individuals; and
12 WHEREAS, pursuant to Act 320 of 1997 the Arkansas General Assembly provided the City
13 with the authority to create Targeted Neighborhood Enhancement ,Act Plans as set forth in the
14 codification of this Act (Ark. Code Ann. §§ 14 -169 -1101 to -1108 [Miehie Repl. 1998]1; and
15 WHEREAS, on November 17, 1998, the Board of Directors adopted Little Rock, Ark.,
16 Resolutien No. 10,406 which authorized the formation of a Philander Smith 'Targeted Neighborhood
17 Enhancement Plan; and
18 WHEREAS, pursuant to this resolution the City developed the necessary background
19 information and conducted the required public hearings; and
20 WHEREAS, the City has compiled the Philander Smith Targeted Neighborhood
21 Enhancement Plan attached as Exhibit A to this Ordinance.
22 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
23 CITY OF LITTLE ROCK, ARKANSAS:
24 SECTION 1. The City adopts the Philander Smith Targeted Neighborhood Enhancement
25 Plan set forth in Exhibit A to this Ordinance.
26 SECTION 2. This plan shall be in duration from August 19, 1999 until August 19, 2004.
27 SECTION 3. The boundaries of the Philander Smith Targeted Neighborhood are set forth
28 in the map located on page 77 of Exhibit A.
29 SECTION 4. Severability. In the event any title, section, subsection, subdivision, paragraph,
30 subparagraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be

invalid or unconstitutional, such declaration or adjudication shall not affect the remainin�pIGruons
of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged
invalid or unconstitutional was not originally a part of this ordinance.
