179521 ORDINANCE NO. 17,952 2 3 AN ORDINANCE TO APPROVE A CONTRACT WITH THE 4 QUAPAW QUARTER ASSOCIATION TO STORE 6 ARCHITECTURAL FABRIC DAMAGED IN THE JANUARY 2 6 21,1999, TORNADO; TO WAIVE COMPETITIVE BIDDING; 7 TO DECLARE AN EMERGENCY; AND FOR OTHER 6 PURPOSES. 9 10 WHEREAS, the January 21, 1999, tornado devastated significant portions of the 11 historical sections of downtown Little Rock, and 12 WHEREAS, as a part of both the cleanup effort and the restoration effort it is necessary 13 to find a place to salvage and store architectural materials as a service to property owners so 14 they can reclaim the material when they are ready to rebuild, and 15 WHEREAS, to date this has been done on an ad hoc basis and the City would like to 16 contract with a knowledgeable organization to assist in this effort, but there is not sufficient 17 time to prepare and review Requests for Proposals, and 18 WHEREAS, it is believed that the cost to the City to provide this service can be 19 reimbursed from funds of the Federal Emergency Management Agency (FEMA) and other 20 appropriate governmental organizations, 21 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 22 THE CITY OF LITTLE ROCK, ARKANSAS: 23 Section 1. The City Manager is authorized to enter into a contract with the Quapaw 24 Quarter Association in an amount not to exceed twenty seven thousand dollars ($27,000) to 26 coordinate efforts to salvage and store architectural fabric from buildings damaged in the 26 January 21, 1999, tornado. The funds for this contract will be sought from FEMA monies or 27 other funds made available to the City by governmental agencies. 28 Section 2. Because of the need to act quickly to salvage and store this sometimes 29 irreplaceable material, and because the initial actions to date have not been able to focus upon 3o this need thus making the delay since the tornado even more significant, the Board of Directors 31 finds that it is impractical and unfeasible to competitively bid for the services provided in this 32 contract. 33 Section 3. Seuerability. In the event any title, subtitle, section, subsection, 34 subdivision, paragraph, subparagraph, item, sentence, clause, phrase, or word of this ordinance 36 is declared to adjudged to be invalid or unconstitutional, such declaration or adjudication shall -1- 1 2 3 4 b 6 7 8 9 10 11 12 13 14 16 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 not affect the remaining portions of this ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of this ordinance. Section 4. Repealer. All ordinances, resolutions, or regulations, or any parts of such documents, which are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. Section b. Emergency. The ability to salvage and store architectural fabric necessary to restore the historical areas of the City damaged by the January 21, 1999, tornado to the architectural and historical significance they enjoyed prior to the storm, and thereby preserve this important part of the City's culture, is essential to the public health, safety and welfare. An emergency is, therefore, declared to exist and this ordinance shall be in full force and effect from and after the date of its passage.
