ORDINANCE NO. 17,923
AN ORDINANCE TO APPROVE A CONTRACT WITH
SHIVA CORPORATION FOR THE PURCHASE OF
CERTAIN COMPUTER EQUIPMENT; TO WAIVE
COMPETITIVE BIDDING; TO DECLARE AN
EMERGENCY; AND FOR OTHER PURPOSES.

WHEREAS, the City has a need to assure that users of its computer system who
modem into the City's computer do so in a manner that will not jeopardize the integrity
of the system, and has a need to assure avoidance of Y2K problems, and
WHEREAS, after research it was deemed possible to obtain certain necessary
13 equipment from Shiva Corporation and to trade -in certain equipment from the City, but
14 this decision had to be made before December 31, 1998, which made the issuance of a
15 formal bid unfeasible and impractical, and
16 WHEREAS, the amount of the contract was within the discretionary authority
17 of the City Manager to award,
1s NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
19 OF THE CITY OF LITTLE ROCK, ARKANSAS:
20 Section 1. The Board ratifies a contract between the City and Shiva
21 Corporation in the amount of $ 20,794.50 for the purchase of certain computer
22 equipment to assist with modem access to the City's computer system, and to help
23 prepare the City for various Y2K issues.
24 Section 2. Because the final decision on the contract had to be made prior to
25 December 31, 1998, and because there was telephonic research done to assure that the
26 price offered for this new equipment would result in substantial savings to the citizens,
27 the Board finds that competitive bidding was impractical and unfeasible.

Section 3. Emergency. The ability to protect the City's computer system from
problems that can arise when outside user modem into the system, and to assure that the
system is not subject to collapse on January 1, 2000, is essential to the public health,
safety and welfare. The contract ratified by this ordinance assisted in both efforts. Ij Js
essential to assure that this contract is fulfilled immediately. An emergency is therefore
declared to exist and this ordinance shall be in full force and effect from the date of its
passage.
