17882r r r r r r �r r r �r r ■� r �r ORDINANCE NO. 17.882 • 597 AN ORDINANCE ESTABLISHING THE CHENAL VALLEY MUNICIPAL PROPERTY OWNERS MULTI- PURPOSE IMPROVEMENT DISTRICT NO. 7 OF LITTLE ROCK. ARKANSAS; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, property owners, claiming to be all the owners of record title of real property located within the territory hereinafter described have filed petitions on November23 , 1998, praying that a municipal property owners improvement district be established pursuant to Ark. Code Ann. Title 14, Chapter 94 for the purposes herein set out, and WHEREAS, the Board of Directors of the City of Little Rock, Arkansas has authority to create such a municipal property owners improvement district in that all of the said territory lies completely within the boundaries of said municipality, and WHEREAS, the Board of Directors of the City of Little Rock, Arkansas has heard all the parties desiring to be heard, and has ascertained that said petitions were signed by all the owners of real property within said territory, now, therefore, IT IS ORDAINED by the Board of Directors of the City of Little Rock, Arkansas: Section 1. There is hereby established a municipal property owners improvement district embracing the property in the City of Little Rock, State of Arkansas, described in the attached Exhibit A, for the purposes of (i) constructing a 7,400 foot extension of Northfield Drive, and improvements to Arkansas State Highway 10 and Northfield Drive at the intersection thereof, together with such other street and road improvements incidental thereto as depicted in the map attached as Exhibit B; and to open, grade, drain, pave, curb, gutter or otherwise improve such other streets, roads, highways, and every other way for passage and use of vehicles, and including sidewalks, pedestrian trails and walkways, viaducts, underpasses and appurtenant lighting, either within or without the boundaries of the district if the property of the district will be benefited thereby, and such purpose shall include the acquisition of rights of way by purchase or the exercise of the power of eminent domain, and to maintain such streets, roads, highways, and every other way for passage and use by vehicles, lying within the boundaries of the district or beyond the boutnes of the district if the property of the di will be benefited thereby; (ii) 598 constructing a twelve (12) inch water main along Northfield Drive as depicted on the map attached as Exhibit B and other appurtenant water improvements; (»i) constructing sanitary sewer force mains, gravity mains, and pump stations as depicted on the map anached as Exhibit B and other appurtenant sewer improvements; (v) acquiring and constructing electric junction boxes, electric conduits and other electric utility improvements as depicted on the map attached hereto as Exhibit B; (v) all other purposes authorized by Ark. Code Ann. Tide 14, Chapter 94 and amendments thereto; and (vi) conducting any and all other ads which shall be deemed necessary in order to purchase, construct, accept as a gift, operate an d maintain any and all improvements authorized therein.. Said purposes are to be accomplished in the manner and with the materials that the commissioners for the district shall deem to be in the best interest of the district and as specified by law. The cost of the project shall be assessed upon the real property of the district according to the benefits received. Section 2. Said district shall be known as the 'Chenal Valley Municipal Property Owners Multi- Purpose Improvement District No. 7 of Little Rock, Arkansas" (the 'District"); and Ron L. Pearce, Clefton D. Vaughan and Bayless Rowe, who are the persons nominated in the petition, are hereby named commissioners and shall compose the Board of Commissioners of the District. Section 3. Emereencv. It is hereby found and declared that an immediate need exists for the street and other improvements in order to achieve the most cost effective financing for the accomplishing of the Master Street Plan of the City. It is, therefore, declared that an emergency exists. This Ordinance, being necessary for the immediate preservation of the public peace, health and safety, shall take effect and be in force from and after its passage. The Board of Directors finds that the City's primary partners in 12 obtaining the Welfare -to -Work gant are vitally necessary to insure its successful 13 implementation. It is therefore impractical and unfeasible to bid these contracts and the 14 requirement of competitive bidding is hereby waived. 15 SECTION 2. The City Manager is authorized to enter into sole source contracts with 16 Arkansas Institute for Social Justice and Local Union 100, First United Methodist Church - 17 Child Development Center, United way of Pulaski County, University of Arkansas at Little 18 Rock, Pulaski Technical College, and University of Arkansas for Medical Sciences /Arkansas 19 Center for Addictions (AR Cares). Individual contract amounts will be determined at the 20 time the City's budget modification is approved by the United States Department of Labor. 21 SECTION 3. Funding is available from the United States Department of Labor, 22 Welfare -to -Work Competitive grant. 23 SECTION 4. Emergency. It is hereby found and determined by the Board of 24 Directors of the City of Little Rock that implementation of the City's Welfare -to -Work 25 program is critical to the success to move welfare recipients into the work force, that certain 26 primary partners of the City furnish integral components of the program and that the program 27 could not optimally operate without them, and that it is essential that the City's program 28 move forward with all deliberate speed.
