AN ORDINANCE TO AMEND LITTLE ROCK, ARK., REV. CODE
3 § 2- 243(a)(2) (1988) TO ADD ADVERTISING DESIGN AND
4 CONSULTATION SERVICES TO THE LIST OF PROFESSIONAL
5 SERVICES; AND FOR OTHER PURPOSES.

8 "AN ORDINANCE TO DECLARE ADVERTISING DESIGN AND
CONSULTATION SERVICES A PROFESSIONAL SERVICE"

10 WHEREAS, pursuant to Ark. Code Ann. § 19 -11 -806 (N ichie Supp. 1997), cities are
11 permitted to define certain activities as professional services for which public contracts are awarded
12 to the most qualified firm as opposed to the firm submitting the lowest price and, in such situation,
13 cities are not permitted to consider price as a part of a bid; and
14 • WHEREAS, the design and packaging of advertising programs and promotional campaigns
15 require a creative process that is not easily amenable to selection on the basis of competitive
16 bidding, and that basing such services solely on price would result in an outcome that would not
17 meet the best interests of the City.
18 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
19 THE CITY OF LITTLE ROCK, ARKANSAS:
20 SECTION 1. Little Rock, Ark., Rev. Code § 2- 243(a)(2) (1988) is hereby amended to add
21 "advertising design and consultation services" to the list of professional services.
