3 AN ORDINANCE TO PLACE ON THE NOVEMBER 3, 1998
4 GENERAL ELECTION BALLOT THE QUESTION OF INCREASING
5 THE TAX ON REAL AND PERSONAL PROPERTY IN THE CITY OF
6 LITTLE ROCK FROM ONE AND EIGHT TENTHS (1.8) MILLS TO
7 TWO AND SEVEN TENTHS (2.7) MILLS TO BE LEVIED AND
8 COLLECTED FOR MAINTENANCE AND OPERATION OF THE
9 PUBLIC CITY LIBRARIES OPERATED BY THE CITY AND THE
10 CENTRAL ARKANSAS LIBRARY SYSTEM; DECLARING AN
11 EMERGENCY; AND FOR OTHER PURPOSES.

13 WHEREAS, pursuant to Amendments 30 and 72 to the Arkansas Constitution, 100
14 or more taxpayers of the City of Little Rock, Arkansas, may file a petition with the Mayor
15 asking that the library tax upon real and personal property be levied and collected for the
16 maintenance and operation of the public city libraries and requiring that the question be
17 submitted to the electors; and
18 WHEREAS, such petition has been submitted to the Mayor in proper form with the
19 required number of signatures.
20 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
21 OF THE CITY OF LITTLE ROCK, ARKANSAS:
22 SECTION 1. That there shall be submitted to the electors of the City, at the November
23 3, 1998 General Election, the question of increasing the annual tax levied for the purpose of
24 maintaining and operating the Public City Libraries operated by the City of Little Rock and the
25 Central Arkansas Library System from one and eight tenths (1.8) mills to two and seven tenths
26 (2.7) mills on the dollar assessed valuation of all real and personal property subject to taxation
27 in the City of Little Rock, Arkansas.
28 SECTION 2. The ballot title on the question of adoption of the Library Tax shall be
29 in substantially following form:

4 (2.7) MILLS ON REAL AND PERSONAL PROPERTY TO BE USED FOR
5 MAINTENANCE AND OPERATION OF THE PUBLIC CITY LIBRARIES
6 OPERATED BY THE CITY OF LITTLE ROCK AND THE CENTRAL ARKANSAS
7 LIBRARY SYSTEM.
8 FOR increase of tax on real and personal property to be used for maintenance and
9 operation of the public city libraries from one and eight tenths (1.8) mills to two and seven

14 SECTION 3. That the results of the election shall be certified by the Election
15 Commissioners and proclaimed by the Mayor, and his proclamation shall be published one time
16 in a newspaper having general circulation in the City, which proclamation shall be conclusive
17 unless attacked in the courts within thirty (30) days.
18 SECTION 4. That the Mayor and City Clerk, for and on behalf of the City, are hereby
19 directed to perform all acts necessary to carry out the intent of this Ordinance.
20 SECTION 5. EMERGENCY. It is hereby found and determined by the Board of
21 Directors of the City that there exists an immediate need for additional revenue for the Public
22 Library operated by the City of Little Rock and the Central Arkansas Library System; that there
23 presently exists an opportunity to place this issue on the November 3, 1998 General Election
24 Ballot, and that this Ordinance should be given immediate effect in order to be timely placed
25 on the ballot for said election to address revenue needs of the public library. Therefore, an
26 emergency is declared to exist, and this Ordinance being necessary for the preservation of the
27 public peace, health, welfare and safety shall be in force and take effect from and after its
28 passage and approval.
