AN ORDINANCE DISPENSING WITH THE REQUIREMENT OF

COMPETITIVE BIDDING AND AUTHORIZING THE CITY
5
MANAGER TO ENTER INTO A CONTRACT WITH PULASKI
6
COUNTY TO ADMINISTER ALTERNATIVE SCHOOL SERVICES
7
TO LITTLE ROCK YOUTH, DECLARING AN EMERGENCY; AND
8
FOR OTHER PURPOSES.

WHEREAS, the Board of Directors may dispense with the requirement of competitive
11
bidding in exceptional situations where such procedure is not feasible; and
12
WHEREAS, the Board finds that an exceptional situation exists in the case of the
13
Pulaski County Step One Alternative School to justify dispensing with competitive bidding; and
14
WHEREAS, the exceptional situation which makes it impractical and unfeasible to use
15
competitive bidding involves factors such as 1) the Pulaski County Step One Alternative School
16
provides education to children referred by the three school districts or the juvenile court system,
17
2) in most instances these children have been expelled from school and attendance at the
18
Alternative School is the only chance they have to maintain their education, and 3) a majority
19
of the students are economically disadvantaged, show signs of drug usage, and are below grade
20
level; and
21
WHEREAS, the Board previously appropriated $35,500 of Prevention, Intervention
22
and Treatment program monies in Little Rock, Ark. Ord. 17,646 (December 16, 1997) for the
23
Step One Alternative School to accommodate 30 expelled students.

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS

OF THE CITY OF LITTLE ROCK, ARKANSAS:

SECTION 1. The Board of Directors of the City of Little Rock finds that competitive
27
bidding should be dispensed with for the purchase of Alternative School Services as an
28
exceptional situation exists and competitive bidding is impractical and infeasible.

SECTION 2. The City Manager is hereby authorized to enter into a contract with
30
Pulaski County to provide Alternative School services for an amount not to exceed $35,500,
31
the amount authorized in Little Rock, Ark. Ordinance 17,646 (December 16, 1997).

SECTION 3. Emergency. It is hereby found and determined that the services performed
33
by the Pulaski County Alternative School are essential to the peace, health, and safety of the
34
youth enrolled in said programs in order to keep them in school to learn basic skills, to learn
35
how to seek and hold jobs, to transition back to a traditional school setting, and that there exists
36
an urgent need for continuation of said program. Therefore, an emergency is hereby declared

1 to exist and this Ordinance being necessary for the preservation of the public, health and safety
2 shall be in full force and effect from and after its passage and approval.
