17725178 ORDINANCE NO. 17,725 1 2 3 AN ORDINANCE DISPENSING WITH THE 4 REQUIREMENT OF COMPETITIVE BIDDING FOR 5 6 CONSTRUCTION AT THE LITTLE ROCK PORT; AND 7 DECLARING AN EMERGENCY. s 9 10 WHEREAS, the Board of Directors may dispense with the requirements of 11 competitive bidding in exceptional situations where such procedure is impractical and r 12 unfeasible; and 13 WHEREAS, the Little Rock Port Authority has requested the Board of Directors 14 15 to adopt such an ordinance dispensing with competitive bidding for the construction of an 16 approximately 3,600 square foot facility at the port terminal site due to the urgency and 17 nature of the construction needed; and 1s WHEREAS, the urgent need for a separate handling and packaging facility is to avoid 19 20 product contamination during the stevedoring and operation of the port; and 21 WHEREAS, it is in the best interest of the City of Little Rock to dispense with 22 competitive bidding in order to provide the proposed facility as soon as possible on the most 23 advantageous terms and conditions and an emergency now exists to accomplish this work. 24 25 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 26 OF THE CITY OF LITTLE ROCK, ARKANSAS: 27 SECTION 1. The Board of Directors hereby finds that competitive bidding for the 2s 29 construction of an approximately 3,600 square foot facility at the port terminal site shall be 30 dispensed with, and the Little Rock Port Authority is hereby authorized to proceed with such 31 construction on such terms and conditions it deems advisable. 32 SECTION 2. EMERGENCY. There is hereby found and declared that the Little 33 34 Rock Port Authority needs to construct or have constructed a handling and packaging facility 35 at the port as soon as possible. Therefore, an emergency is declared to exist, and this 36 (Rec. 6- 4 -98.) ordinance being necessary for the preservation of the public peace, health and safety shall be in force and effect immediately upon and after its passage.
