THE PULASKI ECONOMIC COMMUNITY
ALLIANCE TO PROVIDE BONDING AND
TECHNICAL SUPPORT FOR SMALL BUSINESSES;
DECLARING AN EMERGENCY; AND FOR OTHER
PURPOSES.
"Short Title"
"An Emergency Ordinance to Approve a Contract for
Bonding and Technical Support for Small Businesses"
WHEREAS, as a result of the FUTURE -Little Rock process it was deternined that
the City should promote economic development among small businesses, particular
minority and women owned businesses, and to assist these businesses to compete for City
contracts, and
WHEREAS, the City has determined that it can contract with the Pulaski
Economic Community Alliance to provide bonding and technical support to small
businesses in a race and gender neutral manner,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF

N SECTION 1. The City Manager is authorized to enter into an agreement with the
o Pulaski Economic Community Alliance in a form substantially the same as that attached
o as Exhibit A to this Ordinance, provided that this Agreement shall not be in full force and

o effect until Pulaski County has agreed to an interlocal agreement with the City to serve
as fiscal agent for this contract.
SECTION 2. Emergency Clause. The need for small businesses to compete for

health, safety and welfare of this community; an emergency is therefore declared to exist

1 and this ordinance will be in full force and effect from and after the date of its execution

® AGREEMENT •
This Agreement is entered into this _ day of February, 1998, between the City of
Little Rock, Arkansas ( "City"), a municipal corporation duly organized pursuant to the laws
of the State of Arkansas, and the Pulaski Enterprise Community Alliance ( "PECA ").

WHEREAS, PECA has entered into an agreement with the U.S. Department of
Housing & Urban Development, the State of Arkansas, the City, North Little Rock, and
Pulaski County, pursuant to Title XIII, Subchapter C, Part I of the Omnibus Budget
Reconciliation Act of 1993 (28 U.S.C. §§ 1391, et seq), to assist in certain areas of
economic development, and
WHEREAS, PECA is able to provide bonding and technical support to small
businesses that will enable these businesses to become competitive for the award, through
a competitive bidding process, of City contracts, and
WHEREAS, the City believes that it is in its best interests to enter into such an
agreement and, thereby, to increase the pool of contractors available to compete for City
busines, and
WHEREAS, PECA and the City wish to contract for the provision of certain
services,
NOW, IN CONSIDERATION OF THE COVENANTS AND AGREEMENTS
SET FORTH BELOW, THE PARTIES AGREE AS FOLLOWS:
1. Term This Agreement shall be in effect from and after the date of its execution,
and the adoption of appropriate resolutions by the City Board of Directors and the Pulaski
County Quorum Court, until February 28, 1999. This Agreement may be extended for up
to four additional one year terms, provided that the first extension shall automatically
expire on December 31, 1999, and provided, further, that the City Board of Directors and
the County Quorum Court must adopt a resolution authorizing such extension prior to
December 31 of the year before the extension.

1 2. Consideration. Inaddition to other good and valid consideration set forth within
2 this Agreement, the City agrees to pay a sum, not to exceed one hundred and thirty one
3 thousand dollars ($131,000.00) to PECA for the serivices set forth in this Agreement to be
4 accomplished during the initial term of this Agreement. If this Agreement is extended, the
s parties shall negotiate an additional consideration to cover the services to be provided
6 during the extended term.
7 3. Services to be provided. In consideration of the monies set forth in Section 2,
e PECA agrees to provide the following services to the City:
9 (A) To identify contractors with sales that do not exceed one
10 hundred thousand dollars annually ($100,000.00), but which
11 are able to become qualified to bid on construction contracts
12 within the City if the company is certified as eligible to receive
13 an appropriate construction bond;
14 (B) To establish a clearing house to identify small, minority
15 and women business enterprises and contractors - for
16 purposes of this Agreement, "small' business enterprises are
17 those with sales more than one hundred thousand dollars
18 ($100,000.00) annually, but less than five million dollars
19 ($5,000,000.00) annually;
20 (C) To establish collaborative efforts with existing contractors
21 for public and private partnerships to the extent permitted by
22 Arkansas law;
23 (D) To assist in improving the business climate for small
24 businesses within the City and, to assist in developing a long
25 term plan to leverage and sustain public dollars available to
26 assist small businesses in order to achieve the maximum
27 benefit for such businesses;

15 4. Pilot program. This Agreement sets forth the terms and conditions for a pilot
16 program to see if the City can achieve its interest in expanding the number of small
17 businesses eligible to compete for City contracts through the training and technical support
18 offered by PECA to such businesses.
19 5. Nondiscrimination. Except for the size parameters set forth above, PECA shall not
20 discriminate against any person, partnership, corporation or business on the basis of race,
21 sex, creed, national origin or disability. Nothing within this provision limits the ability of
22 PECA to legitimately set the size of any training classes and, upon that size being reached
23 upon a "first come first served," basis, to close the class.
24 6. Pulaski County as fiscal agent. PECA is currently using Pulaski County as its fiscal
Z5 agent for a similar program being carried out through a federal grant made available
26 through the State of Arkansas. The City agrees that PECA may use Pulaski County, to the
27 extent required by PECA, as its fiscal agent for purposes of carrying out the terms of this
28 Agreement. To that end, the City agrees to enter into an interlocal agreement, pursuant

(E) To help increase construction opportunities for both

PECA and city residents;

(F) To assist in developing an expanded pool of small
4
businesses, including minority and women owned businesses,
5
by helping these businesses to obtain necessary bonding
6
capacities in order to compete for City contracts and meet
7
state statutory bonding requirements in order to qualify as a
8
responsible and responsive bidder;
9
(G) To serve additional contractors within the City limits
10
that are not already included within the PECA boundaries

existing on the date this Agreement is executed;
12
(H) To expand training for small businesses and contractors
13
with particular emphasis on the process to qualify for
14
bonding.

2 such an interlocal agreement is attached as Exhibit A to this Agreement. Nothing within
3 this Section prohibits PECA from designating another fiscal agent to be used for the
4 purposes of this Agreement, provided that any other fiscal agent is acceptable to the City
5 as evidenced by the written consent of the City Manager.
6 7. Amendments in writing. There shall be no amendment to the terms of this
7 Agreement unless executed in writing by the City and PECA and attached as an addendum
s to this Agreement.
