17668G] 11 1 ORDINANCE NO. 17,668 2 3 AN ORDINANCE AMENDING LITTLE ROCK CODE 4 5 §14 -2(b) TO PROHIBIT SMOKING IN ELEVATORS; 6 DECLARING AN EMERGENCY; AND FOR OTHER 7 PURPOSES. s 9 10 WHEREAS, the City of Little Rock (City) has decided to take an active role to 11 minimize the health and safety risks inherent in the use of tobacco products to all persons 12 13 exposed directly or indirectly to tobacco smoke; and 14 WHEREAS, the City has previously enacted Little Rock, Ark., Ord. No. 16,665 15 ( "LRO ") which sought to regulate smoking in public places; and - 16 WHEREAS, no prohibition against smoking in elevators was contained in LRO 17 18 16,665, and as a result an unnecessarily large segment of the public who must use-elevators 19 can be exposed to the dangers of tobacco smoke. 20 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 21 22 OF THE CITY OF LITTLE ROCK, ARKANSAS: 23 SECTION 1. Little Rock, Ark., Rev. Code §14 -2 (b)(1988) is hereby amended to 24 add §14- 2(b)(6), as follows: 25 Any elevator located in any building in the city to which members of the 26 27 general public have access. 28 SECTION 2. Emergency. The dangers to the health, safety, and welfare of the 29 public from exposure to first- and second -hand tobacco smoke have been well- documented. 30 31 This ordinance is essential to minimize the health risks involved by the use of smoking 32 tobacco products in enclosed areas such as elevators.
