ORDINANCE NO. 17,578
AN ORDINANCE VACATING A PUBLIC UTILITY EASEMENT
IN LOTS 7A AND 7B, EAGLE COMMERCIAL SUBDIVISION NO. 3,
CITY OF LITTLE ROCK, ARKANSAS.
WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock,
Arkansas on thel5th day of August, 1997, asking the Board of Directors to vacate all that portion of
the public utility easement designated on the plat of Lots 7A And 7B, Eagle Commercial Subdivision No.
3, to the City of Little Rock, Arkansas, now appearing of record in Plat Book C, Page 323, in the office of
the Recorder of Pulaski County, Arkansas.
WHEREAS, after due notice as required by law, the Board has, at the time and place mentioned
in the notice, heard all persons desiring to be heard on the question and has ascertained that the
easement, or portion thereof, hereinbefore described, has heretofore been dedicated to the public use as
a utility easement herein described; is no longer necessary due to the proposed redevelopment of Lots
7A and 7B; that all the owners of the property abutting upon the portion of the utility easement to be
vacated have filed with the Board their written consent to this action; and that public interest and welfare
will not be adversely affected by the vacating of the utility easement.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas, releases, vacates and abandons all its rights,
together with the rights of the public generally, in and to the utility easement designated as follows:
UTILITY EASEMENT DESCRIPTION
A part of Lot 7A and 7B, Eagle Commercial Subdivision to the City of Little Rock,
Pulaski County, Arkansas as Recorded on November 2, 1987, Document Number 87- 68795,
Plat Book C page 323 in the Pulaski County Circuit Clerk's office being more particularly
described as follows:
The South 5 feet of said Lot 7A and the North 5 feet of said Lot 7B lying parallel
to the common boundary line between said Lot 7A and Lot 7B Eagle Commercial
Subdivision, to the City of Little Rock, Pulaski County, Arkansas Containing 0.058
Acres (2,504 Sq. Ft.) more or less.
SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the Office
of the Recorder of Pulaski County and recorded in the records of the County.
SECTION 3. This Ordinance shall take effect and be in force from and after its passage an
approval.
