AN ORDINANCE AMENDING ORDINANCE NO. 17,262
REPEALING CHAPTER 28 OF THE LITTLE ROCK, ARK.
REVISED CODE OF ORDINANCES AND ADDING A NEW
CHAPTER 28 RELATING TO CONTROLLING THE STORAGE,
COLLECTION, TRANSPORTATION, TREATMENT,
PROCESSING, AND DISPOSAL OF ALL RESIDENTIAL
SOLID WASTE GENERATED WITHIN THE CITY OF LITTLE
ROCK, ARKANSAS, AND FOR OTHER PURPOSES.
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. Section 25 of Little Rock, Ark. Ordinance No.
17,262 is hereby amended to add an additional paragraph as
follows:
The City Manager is hereby authorized to negotiate
volume discount agreements with City Landfill customers. The
volume discount amount(s) is based upon the volume of solid
waste the customer delivers to the Landfill and the
incremental costs to the Landfill of providing the services
to the volume discount customer. To be eligible for a volume
discount, the customer shall deliver a minimum yearly average
of two thousand five hundred (2,500) tons of solid waste per
month to the: Landfill. The above - mentioned incremental costs
include bond interest, personnel, benefits, material,
equipment, and capital equipment.
All volume discount agreements and amounts shall be
prior approved by the City Board of Directors.
SECTION 2. Severability. The provisions of this
ordinance are severable, and if any part of this ordinance
should be found to be invalid, such invalidity shall not
affect the remaining provisions.
