173287!4 ORDINANCE NO. 17,328 AN ORDINANCE ABANDONING AND CLOSING A PORTION OF COMMERCE STREET BETWEEN BLOCKS 1 AND 2, POPE'S ADDITION IN THE CITY OF LITTLE ROCK, ARKANSAS. WHEREAS, it has been determined that a portion of Commerce Street in the City of Little Rock, Arkansas, is no longer needed for corporate purposes except for public utility, drainage and access purposes. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its right, together with the rights of the public in and to the street right -of- way designated as follows: That portion of Commerce Street north of East Markham Street, between East Markham Street and the Union Pacific Railroad right -of -way and lying between Blocks and 2, Pope's Addition in the City of Little Rock. SECTION 2. The City specifically retains the right to use, and allow others to use the former street right -of -way in its entirety as a public utility, drainage and access easement. SECTION 3. Abutting owners of record, receiving title to the abandoned right - of -way and easement shall at their cost remove all vestiges of public use and access as may exist; such modifications shall include, but are not limited to the following: A. The entrances on both ends of the abandoned right -of -way and easement shall be offset and/or rebuilt to conform to the standard driveway design as required by Ordinance No. 12,501. B. The edge of pavement of the right -of -way shall be rebuilt to conform to existing conditions in the general vicinity where the abandoned right -of -way and easement intersects with the remaining public right -of -way. SECTION 4. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the Office of the Recorder of Pulaski County and recorded in the records of the County. SECTION 5.
