17273_s___________�_ • • 1 617 2 3 4 ORDINANCE NO. 17,273 5 AN ORDINANCE TO PROVIDE AN 6 ALTERNATIVE METHOD OF TIME PAYMENT 7 IN THE LITTLE ROCK MUNICIPAL COURTS, 8 PURSUANT TO AUTHORITY GRANTED IN 9 ARK. CODE ANN. §16 -10 -209 (5)(F)(ii) (MICHIE 1994), AND FOR OTHER 10 PURPOSES. 11 12 WHEREAS, the City of Little Rock is required by law. to 13 collect and remit court costs to the State of Arkansas and 14 Pulaski County; and WHEREAS, state law authorizes a time (installment) payment 15 but requires that all monies collected in such time payment of 16 fines and costs be allocated to costs until such costs are fully 17 paid; and 18 WHEREAS, under such time pay allocation the City often receives no fines whatsoever; and 19 WHEREAS, Ark. Code Ann. §16 -10 -209 (5)(F)(ii)(Michie 1994) 20 provides an alternate method of time pay allocation of fifty 21 percent to fines and fifty percent to costs, if the governing 22 body passes an ordinance authorizing such alterative method; 23 and WHEREAS, such alternative method would increase the amount 24 of fine money collected by the City of Little Rock. 25 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 26 THE CITY OF LITTLE ROCK, ARKANSAS: 27 SECTION 1. All time payments shall be allocated fifty 28 percent (50 %) to court costs and fifty percent (50 %) to fines. Whenever either court costs or fines are fully paid, all 29 remaining time payments shall be allocated to remaining amounts 30 due. A separate monthly report for all time payments on accounts 31 shall be made. The monetary settlement for this separate court 32 report shall be made on or before the fifth day of the 33 next - following month. SECTION 2. The Finance Department, the Department of Data 34 Processing, and the City Attorney are directed to take the 35 necessary steps to put this alternative method into place.
